چكيده فارسي :
موضوع نوشتار پيش رو، بازجستي برتعامل پليس با شوراي حل اختلاف در فرآيند ميانجي گري كيفري مي باشد. رسالت اصليِ نوشتار پيش رو كه با روش توصيفي ـ تحليلي و از مطالعات كتابخانه‌اي به‌عنوان ابزار كار بهره برده است، پاسخ به اين مسأله است كه چه پيامدهايي بين پليس و شوراي حل اختلاف در تعامل با نظام ميانجي گري كيفري برقرار است؟ اين مقاله پس از تبيين كوتاه نظريه عدالت ترميمي در قلمرو علوم جنايي، به ويژه، جرم شناسي، اهم منابع وحياني و اسلامي مولدّ نهادهاي ارفاقي حقوق اسلامي را نقل كرده و از ديگر سو، تحليل مي كند كه منابع اسلامي چه رهيافت هايي براي برون رفت گفتمان عدالت ترميمي از چالش هاي فرارو به دست مي دهند. و در نهايت تلاش مي شود با بررسي نقش شوراهاي حل اختلاف در اجراي برنامه هاي ميانجي گري كيفري، بايسته ها و الزاماتي كه پليس به عنوان كنشگر مؤثر در اين عرصه بيان مي گردد، سعي گرديده به سؤالاتي كه در اين مورد وجود دارد پاسخ داده شود.
چكيده لاتين :
The subject of the present article is the investigation of the police interaction with the Dispute Resolution Council in the criminal mediation process. The main mission of the present article, which uses descriptive-analytical method and library studies as a tool, is to answer the question: What are the consequences between the police and the Dispute Resolution Council in dealing with the criminal mediation system? After a brief explanation of the theory of restorative justice in the field of criminal sciences, in particular, criminology, this article quotes the most important revelatory and Islamic sources generating the benevolent institutions of Islamic law and on the other hand, analyzes what approaches Islamic sources took to get out. The discourse of justice restores the challenges that lie ahead. Finally, by examining the role of dispute resolution councils in the implementation of criminal mediation programs, the requirements and requirements that the police as an effective actor in this area is expressed, an attempt is made to answer the questions that exist in this regard. .
