چكيده فارسي :
ﺑﺤﺚ ﭘﯿﺮاﻣﻮن ﻣﺸﺮوﻋﯿﺖ درآﻣﺪزاﯾﯽ ﺑﺎ اﺳﺘﻔﺎده از ﺗﺎرﻧﻤﺎﻫﺎي ﺗﺒﻠﯿﻐﺎﺗﯽ و ﻣﻮﺿﻮع ﺷﻨﺎﺳﯽ آن اﺳﺖ. ﺑﻪ اﯾﻦ ﺑﯿﺎن ﮐﻪ اﻣﺮوزه ﻣﻌﺎﻣﻼت و ﻗﺮاردادﻫﺎي ﺟﺪﯾﺪي ﺑﻪوﺟﻮد آﻣﺪه ﮐﻪ ﺣﮑﻢ ﺑﯿﻦ ﻣﻌﺎﻣﻼﺗﻰ ﮐﻪ در زﻣﺎن ﺷﺎرع ﻣﺘﺪاول ﺑﻮده و ﻣﻌﺎﻣﻼﺗﻰ ﮐﻪ اﻧﺪﮐﻰ ﭘﺲ از زﻣﺎن ﺷﺎرع ﻣﺮﺳﻮم ﺷﺪه اﺳﺖ و ﯾﺎ ﻣﻌﺎﻣﻼﺗﻰ ﮐﻪ ﻫﺮ روز در ﺑﺎزار ﮐﺎﻻ و ﺧﺪﻣﺎت اﻧﺠﺎم ﻣﻰﺷﻮد، ﺗﻔﺎوﺗﻰ وﺟﻮد ﻧﺪارد، ﺳﻮال ﮐﻠﯿﺪي اﯾﻦ اﺳﺖ ﮐﻪ ﮐﺴﺐ ﻣﺎل از اﯾﻦ ﻃﺮﯾﻖ ﭼﻪ ﺣﮑﻤﯽ دارد؛ از اﯾﻦرو ﻣﻮﺿﻮع ﺷﻨﺎﺳﯽ در ﻣﺮﺣﻠﻪ اول و ﺗﺒﯿﯿﻦ ﺣﮑﻢ ﮐﺴﺐ ﻣﺎل از ﻃﺮﯾﻖ ﺗﺎرﻧﻤﺎﻫﺎي ﺗﺒﻠﯿﻐﺎﺗﯽ ﻣﺴﺄﻟﻪ اﺻﻠﯽ اﯾﻦ ﭘﮋوﻫﺶ ﻣﯽﺑﺎﺷﺪ. ﮐﻪ ﺑﺎ روش ﺗﺤﻠﯿﻠﯽ ﺗﻮﺻﯿﻔﯽ و اﺟﺘﻬﺎدي ﺻﻮرت ﻣﯽﭘﺬﯾﺮد. ﺑﺎ ﺑﺎزﺧﻮاﻧﯽ ادﻟﻪ ﻓﻘﻬﯽ، ﺷﻮاﻫﺪ و ﻗﻮاﻋﺪ ﻓﻘﻬﯿﻪ ﺗﺒﯿﯿﻦ ادﻟﻪ ﮐﺴﺐ ﻣﺎل از ﻃﺮﯾﻖ ﻋﻘﻮد اﺳﻼﻣﯽ ﺑﺮ ﻣﺴﺎﻟﻪ و ﻧﻘﺪ و ﺗﺤﻠﯿﻞ اﺟﺘﻬﺎدي دﻻﯾﻞ ﻣﯽﺗﻮان ﮐﺴﺐ ﻣﺎل از ﻃﺮﯾﻖ ﺗﺎرﻧﻤﺎﻫﺎي ﺗﺒﻠﯿﻐﺎﺗﯽ را ﻣﺸﺨﺺ ﮐﺮد. ﭘﺲ از ﻧﻘﺪ و ﺑﺮرﺳﯽ ادﻟﻪ ﺟﻮاز ﮐﺴﺐ از ﻃﺮﯾﻖ ﻋﻘﺪ ﺟﻌﺎﻟﻪ، ﺑﯿﻊ و اﺟﺎره؛ در ﻧﻬﺎﯾﺖ اﯾﻦ ﻧﻮع ﮐﺴﺐ ﻣﺎل از ﻃﺮﯾﻖ ﻋﻘﺪ ﺟﻌﺎﻟﻪ اﺛﺒﺎت ﻣﯽﺷﻮد. اﻓﺰون ﺑﺮ آن ﮐﺴﺐ ﻣﺎل از ﻃﺮﯾﻖ ﻏﯿﺮ ﻣﺘﻌﺎرف و ﺑﺎزدﯾﺪ ﻏﯿﺮ واﻗﻌﯽ )از ﻃﺮﯾﻖ رﺑﺎ( ﻃﺒﻖ ﻗﻮاﻋﺪ ﻓﻘﻬﯽ اﮐﻞ ﻣﺎل ﺑﻪ اﻟﺒﺎﻃﻞ، ﻗﺎﻋﺪه ﺿﺮر و ﻏﺮر ﺣﺮام ﻣﯽﺑﺎﺷﺪ.
چكيده لاتين :
The discussion is about the legitimacy of generating income using advertising websites and its subject matter. To say that today there are new deals and contracts that there is no difference between transactions that were common during the time of Shariah and transactions that became customary a little after the time of Shariah or transactions that are done every day in the market of goods and services. The key question is what is the ruling on acquiring money in this way; Therefore, the thematic analysis in the first stage and explaining the rule of earning money through advertising websites is the main issue of this research. which is done by analytical-descriptive and ijtihad method. By re-reading jurisprudential evidences, jurisprudential evidences and rules explaining the evidences of acquiring money through Islamic contracts on the issue and criticizing and ijtihad analysis of the reasons, it is possible to determine the acquisition of money through advertising websites. After reviewing the proofs of the license to acquire through the Jaala contract, sale and lease; Finally, this type of acquisition of wealth is proved through the Jaala contract. In addition, according to the jurisprudence rules, the acquisition of wealth through non-conventional means and unreal visitation (through usury) is forbidden.
