تبيين روابط تعاملي ابعاد حاكميت قانون با استفاده از تكنيك‌هاي دلفي، ديمتل فازي و معادلات ساختاري (مورد مطالعه: خبرگان بخش آموزشي و دانشگاهي و مديران سازماني)

Explaining the Interactive Relationships of the Dimensions of the Rule of Law Using Delphi Techniques, Fuzzy Dematel and Structural Equations (Case Study: Experts in the Educational and Academic Sector and Organizational Managers)

اصل «حاكميت قانون» يكي از مهم‌ترين شاخصه‌هاي زمامداري، اعمال حاكميت و نيز حكمراني خوب در دوران معاصر، محسوب مي‌شود. هدف اصلي اين پژوهش تبيين روابط تعاملي حاكميت قانوني در بخش دولتي ايران با استفاده از تكنيك‌هاي دلفي و ديمتل فازي مي‌باشد. جامعه خبرگي تحقيق تعداد 12 نفر و تعداد جامعه آماري 100 نفر از متخصصان دانشگاهي و مديران سازمان‌هاي دولتي كه نمونه آماري آن براساس روش تصادفي ساده و براساس جدول مورگان 80 نفر مي‌باشد. براي تأييد پايايي از آزمون آلفاي كرونباخ و براي تأييد روايي از شاخص GOF استفاده شد. اين پژوهش بر آن است تا بررسي ادبيات مربوط حاكميت قانون، شاخص‌هاي اساسي حاكميت قانون را با استفاده از روش دلفي شناسايي كرده و با استفاده از روش ديمتل فازي، الگوي نظام‌مند را براي مدل سازي و تأثير مولفه‌ها و در نهايت الگوي معادلات ساختاري را براي برازش مدل حاكميت قانون ارائه كند. نتايج حاصل از پژوهش بيانگر آن است كه ابعاد حاكميت قانون عبارتند از: آزادي‌هاي سياسي، آزادي‌هاي مدني و اجتماعي، حقوق اقتصادي، حقوق رفاهي، حقوق اداري و اجرايي، آزادي‌هاي قضايي. براساس نتايج ديمتل حقوق رفاهي، حقوق اداري و اجرايي اثرپذيرترين مؤلفه‌ها و آزادي‌هاي سياسي، آزادي‌هاي قضايي و كيفري، آزادي‌هاي اجتماعي و مدني، حقوق اقتصادي اثر گذار ترين مؤلفه‌ها هستند. نتايج بدست آمده مي‌تواند به سياستگزاران بخش عمومي و مديران دستگاه‌هاي اجرايي و قضايي در برقراري اصل حاكميت قانون كمك نمايد.

The principle of "rule of law" is considered one of the most important features of governance, the exercise of governance and good governance in the contemporary era. The main goal of this research is to explain the interactive relationships of legal governance in the public sector of Iran using Delphi and Fuzzy Dematel techniques. The research expert community is 12 people and the statistical community is 100 academic experts and managers of government organizations, whose statistical sample is 80 people based on the simple random method and based on Morgan's table. Cronbach's alpha test was used to verify reliability and GOF index was used to verify validity. This research aims to review the literature related to the rule of law, identify the basic indicators of the rule of law using the Delphi method, and using the fuzzy Dematel method, a systematic model for modeling and the effect of the components, and finally a structural equation model for fitting. Provide a rule of law model. The results of the research show that the dimensions of the rule of law are: political freedoms, civil and social freedoms, economic rights, welfare rights, administrative and executive rights, judicial freedoms. According to the results of Dematel, welfare rights, administrative and executive rights are the most effective components and political freedoms, judicial and criminal freedoms, social and civil liberties, economic rights are the most effective components. The obtained results can help public policy makers and managers of executive and judicial institutions in establishing the principle of rule of law.
