چكيده فارسي :
طلاق و گسست خانواده در دين اسلام، امري نكوهيده و مورد غضب خداوند است ولي اگر تداوم زندگي مشترك به خاطر ناسازگاري شديد و پايدار، ميسر نباشد، جدايي همسران موجه مي نمايد. تعبير قرآني «سراحا جميلا» (احزاب/ 28، 49)، بر ضرورت زيبا و اخلاق مدارانه بودن شيوه تعامل همسران با يكديگر در فرايند طلاق دلالت دارد تا ضمن رهايي زن، كرامت وي نيز مخدوش نگردد. اين پژوهش كه با روش توصيفي - تحليلي سامان يافته، پس از بررسي مفهوم «سراح جميل»، به بازخواني و مستندسازي ديدگاه هاي مفسران در مورد اين آموزه قرآني پرداخته تا شاخصه هاي ايجابي و سلبي طلاق زيبا را ارايه نمايد. يافته هاي پژوهش بيان گر آن است كه واژه «جميل» در قرآن كريم در مورد راهبرد شايسته و زيباي انسان ها در شرايط طاقت فرسا به كار رفته و انگيزه مثبت، رعايت مقررات طلاق، ايفاي شايسته حقوق مادي و معنوي، ياس از اصلاح و آشتي، خوش گفتاري و خوش رفتاري، مشورت و توافق سازنده، پاسداشت حرمت يكديگر و احترام به حق انتخاب همسر آينده، بخشي از شاخصه هاي ايجابي طلاق زيبا است و در مقابل، خشونت هاي گفتاري و رفتاري، ضرر رساني و ستم بر يكديگر، كتمان حقايق، بهتان و رفتارهاي گناه آلود، بخشي از شاخصه هاي سلبي طلاق زيبا است.
چكيده لاتين :
Divorce and family separation in Islam is condemned and angered by God Almighty, but if the continuation of cohabitation is not possible due to severe and lasting incompatibility, the separation of spouses is justified. The Qur'anic interpretation of "sarahi jamil" in verses 28 and 49 of Surah Al-Ahzab indicates the need for a beautiful and morally oriented way of interaction between spouses in the divorce process so that while liberating the woman, her dignity does not be tarnished. This study, after examining the concept of "sarahi jamil", has read and documented the views of commentators on this Qur'anic teaching in order to present the positive and negative characteristics of meritorious divorce. The findings of the study indicate that the word "jamil" in the Holy Quran is used about the proper and meritorious strategy of human beings in oppressive conditions; and positive motivation, observance of divorce rules, proper fulfillment of material and spiritual rights, despair of reconciliation, kindness and good behavior, constructive consultation and useful agreement, respect for each other and respect for the right to choose a future spouse are some of the positive characteristics of a jamil/beautiful divorce, and in contrast, verbal and behavioral violence, harm and oppression toward each other concealment of facts, slander and sinful behaviors are some of the negative characteristics of a beautiful divorce.
