The Impact of the COVID-19 Pandemic on the Outlook for International Health Commitments

اگر چه مطابق اسناد بين‌المللي حق ‌برسلامت همواره تعهدي ملي محسوب شده و فاقدالزامات بين‌المللي است، ولي خطر روزافزون بيماري‌هاي فراگير مي‌تواند موجب اثرگذاري فرامرزي عدم تحقق مناسب حق مذكور شود. دغدغه‌اي كه موجب تبديل خطر شيوع همه‌گيري به تهديدي جهاني مي‌شود. در چنين چشم اندازي، آيا دامنه تاثير فرامرزي همه‌گيري‌ها خواهد توانست سبب ارتقاي تعهدات حق ‌برسلامت به سطح بين‌المللي شود؟ براي پاسخ به اين پرسش، با بررسي فرآيند توسعه تعهدات بين‌المللي كشورها، ذيل صلاحيت شوراي ‌امنيت سازمان ‌ملل ‌متحد، نخست با روشي توصيفي تفسير امنيتي از تحقق نيافتن مناسب حق ‌برسلامت ارائه خواهيم داد. سپس با تحليل آماري درخصوص قربانيان ابولا و كرونا، درپي اثبات مفروض افزايش سطح نيازعيني به تفسير جدي‌تر از تعهدات بين‌المللي خواهيم پرداخت. درمجموع، با آن‌كه مشكل تفاوت نگرش‌ها و رقابت ميان قدرت‌هاي جهاني همچنان وجود دارد، اما تشديد ابعاد مختلف خطر همه‌گيري‌ها درسطح بين‌المللي، جامعه جهاني را ناگزير به پذيرش تعهدات جدي‌تر دراين حوزه خواهد نمود.

Although, according to international instruments, the right to health has always been a national obligation and lacks international requirements, the growing risk of communicable diseases can have a transboundary impact on the inadequate realization of this right. A concern that might make a pandemic outbreak a global threat. Thus, will the transnational impact of pandemics enhance the level of health obligations from national to international? To answer this question, by examining the developing process of countries’ international obligations, under the authority of the United Nations Security Council, we will first assess the security interpretation of inadequate realization of the right to health. Then, by comparing the statistics of Ebola and corona victims, we will try to prove the need for a more objective need for a serious interpretation of international obligations. In conclusion, although there are differences in attitudes and rivalries between world powers, the escalation of the various dimensions of pandemics at an international level will force the international community to accept more serious commitments in this area.
