امكان‌سنجي صدور حكم اخلال در نظام اقتصادي كشور بر قاچاقچي

يكي از مسايلي كه امروزه به نحو گسترده‌اي نظام اقتصادي كشور را تهديد مي‌كند، قاچاق كالا و ارز است. بر همين اساس، جرم انگاري و تشديد كيفر اين جرم مي‌تواند هزينه ارتكاب جرم را افزايش دهد تا ميزان جرم كاهش يابد.لذا، بايد به تطبيق عناصر جرم مزبور با عناصر سه گانه جرم اخلال در نظام اقتصادي كشور پرداخته شود. بر همين اساس، در باب عنصر مادي لازم مي‌آيد كه براي كشف رابطه عليت، از رفتار قاچاقچي و وقوع اخلال در نظام اقتصادي، به متخصصين اين حوزه رجوع شود. در اين مورد تبصره 1 ماده 1 قانون مجازات اخلالگران در نظام اقتصادي به مسئله مذكور اشاره داشته است. لذا در باب عنصر مادي نيز بايد اذعان داشت آن چه در باب اخلال، نقطه ثقل مواد مربوط بدان را تشكيل مي‌دهد، حصول اخلال در نظام توليدي كشور است. در تطبيق عناصر معنوي نيز بايد اذعان داشت كه اگر قاچاقچي در پي قاچاق كالا بوده لكن قصد اخلال يا علم به وقوع آن نداشته است بعيد است كه بتوان ايشان را اخلالگر نظام اقتصادي كشور دانست. در باب عنصر قانوني نيز به مواد قانوني در اين زمينه پرداخته خواهد شد و در نهايت انطباق قاچاقچي كالاو ارز با حصول شرايط خاص واطلاق عنوان اخلال در نظام اقتصادي به وي ضروري مي‌نمايد.
