A STUDY OF THE CAPABILITIES OF SHIT REFORMIST DISCOURSE IN IRAN

The Present article is an attempt to study the intellectual and jurisprudential capabilities. Aluding to two approaches, that is, legalists Traditionalists, the author elaborates upon the jurisprudential characteristics and bases of legalists shiite jurisprudents and maintains that the said jurisprudents lay emphasis on such elements as comprehensiveness of Sharia, acceptance of the competence of reason and commonsense and individual reasoning, acceptance of the principle of following of decrees of exigency and harm. The role of government and governmental decrees, role of time and space, etc. enjoy a high potential in facing the new developments. This intellectual capability supports the reforms in the society and accelerate the pace of the process of rationlization.
