OPERATION OF PUBLIC WATERS ACCORDING TO IRANIAN LAW

The droughts of recent years which has resulted in a critical water situation in our country, necessitates further examination of just water distribution law approved in 1982 particularly in the field of "public Waters Operations". In this regard, a comparative study of the laws of the countries which are similar to our country in terms of atmospheric conditions could help us to reveal the defeciencies of Iran Law. In this paper, we study the legal situation of the kinds of operations in the first discussion, and provide some suggestons for reforms. Next, in the second discussion, ways of ownership and possession of lands and buildings needed for operation of public waters are studied, and then according to present regulations, and vote No. H35/74 of Justice Tribunal Court administration which authorizes government free use of other rights (exept ownership) of lands including right of easement are criticized.
