Introduction: Sonmumbulism is a legal and medicine subject. therefore. the study of (his topicfrom psvchiotric and the law viewpoint is important, because in some criminal recordsʹ somnambulism is considered as a defence against attributed charges. The aim ofthis research, is to explicate the topic tSomnambulism) from psychiatric. religious and legal viewpoints and tv compare if with other legal systems. Discussion: Many researches have shown that persons who suffer ofsomnambulism should be considered as no guiuvfor probable criminal act during steep walking. because they have no volition and arc nul alert ofthe quality and nature oftheir act and not aware ofthe results; Concoquenttv. they are free otcriminot tiabitity. Conclusions: One can come /0 the conclusion thai when reviewing or compiling Islamic Criminal Law. steep must explicitlv considered as alae/or removing criminal responsibility and consecutively removing criminal liabilitvfrom those 11ʹhO commit a crime while sleepwalking (both natural or magnetic) or being affected by psychiatric disorders. due 10 lack ofguilt and mental aspect ofthe crime: so as 10 prevent punishment of those commit crimes without anv intensions and volitions.
