The Rate and the Amount of Dower from The viewpoint of Revelation

This paper is an attempt to analyze the most important basis of commentators and jurists concerning the indefinite amount of dower with a conclusion that although the principle of determining dower depends upon the consent of spouses, according to the Quranic verses, the dower should be paid and there should be no repayment. Also, according to Sura Al- Nesa (Women: v.4), the dower is considered as a present or gift (Nehla or Heba), and based on the usage and wisdom and norms, the gift should not be beyond what the husband can afford. Similarly, according to the prophet and the infalliblesʹ traditions, the rate and amount of dower should be determined, so that the husband can afford it; therefore, it is not true or legitimate that the amount of dower should be more than the amount the husband can afford. How= ever, there is no limitations, the spouses should both agree on it, so that it can be true and legitimate
