Inaction as Criminal act

Being one of the important and challenging issues of penal code the question whether or not it is possible to perpetrate a crime (which is usually done through positive acts against a persons physical integrity), through inaction, has been discussed by various jurists. Based on Iranʹs Islamic penal code and based on the conclusion of this study, inaction can also be characterized as a criminal act. This is because inaction also carries the main elements necessary for a criminal act. The main objective of this article is to prove that inaction is just like action in being able to be the cause of a crime. Thus the skepticisms raised by some experts in his regard, are not acceptable. The author uses a descriptive analytic method to prove his point of view.
