Imam Khomeini was believed that the outhority of the junst (Foqaha) for foundation of Government is like outhority of Islam prophet. Prophet and Innocent Imams. In the thought of Imam Khomeini the foundation of Government by the jurist (Foqaha) is necessary and if this was not possible, the authority of them became not decline, Because they were appointed By Allah. This article examine the circumstances of Imam Khomeiniʹs reasoning on "Wilayat" and his rudiments in the explain of that as a self - evident matter -irrespective of traditional causes for the Jurist authority in the Gheybat (absence of Imam) period - historical excursion and continuity of wilayat faqih theory from Sheikh Mofid to Imam Khomeini and necessity of Foundation of the Islamic Government for execution of divine law (shariat).
