بررسي علل اختلاف آراي فقها در رويكرد به اخبار

اختلاف آراي فقها امري است كه در فقه كاملا ملموس و مشهود است. اين اختلاف نظرات مي تواند معلول علل مختلي باشد. از جمله: اختلاف در تقسيم بندي اخبار كه شامل اختلاف نظر اخباريون و اصوليون مي شود. يا تعارض اخبار و راه هاي علاج آنها كه تعارض خود مي تواند دلايل و عوامل متعددي داشته باشد. عواملي مانند پيش فرض هاي فقيه در مراجعه به منابع فقه و يا دامنه اطلاع او از موضوعات احكام نيز مي تواند از علل اختلاف آراي فقها باشد . همچنين سند يك روايت نيز از نظر فقيه مي تواند مقبول يا مردود باشد كه خود در تصميم گيري فقيه نقش عمده دارد. دلايل ديگري نيز در اختلاف آراي فقها در رويكرد به اخبار نقش اساسي دارد كه در اين جستارمورد بررسي قرار مي گيرد.

Difference of opinions among the jurists is quite tangible and obvious in jurisprudence. This difference of opinions can have various reasons, including difference in categorizing traditions, which arises from difference of opinion between akhbariyun (traditionists) and usuliyun (legal theorists), or the conflicts between traditions and the ways of their resolving. These conflicts may have numerous reasons and causes such as the juristʹs preconceptions when referring to legal sources, or the scope of his knowledge about the subjects of the rulings, which can be among the reasons for the juristsʹ difference of opinions. Furthermore, the sanad (chain of transmission) of a tradition can be accepted or rejected from a juristʹs point of view, which in itself has a major role in the juristʹs decision making. There are also other reasons having a major role in the juristsʹ difference of opinions in their approach to traditions, which are dealt with in this research.
