دو جريان اخباريّه و سلفيّه در مواجهه با عقلانيّت تشريعيّ

تاريخ فقه اسلامي شاهد شكل‌گيري دو جريان به ظاهرهم‌سو و مشابه - هر چند در دو مقطع زماني و با جلوه هاي متفاوت - بوده است. يك جريان، جنبش أخباريّه در مكتب اماميّه است كه با رويكردي تازه در باب شريعت‌ورزي، ضمن نفي اجتهاد،عقل را در رسيدن به احكام شرعي، ناتوان مي‌شمارد. جريان دوم سلفيّّه است كه در ميان اهل‌سنّّّت، اگر چه در اساس يك جريان اعتقادي است و صرفاً يك حركت فقهي نيست، اما در عرصه فقه و شريعت نيز نگاههاي ويژه اي داردكه تاحدود زيادي مشابه ديدگاه هاي اخباريّه است. ژرف‌انديشي در آموزه‌ها، رويكردهاي كلان و متدولوژي اين دو جريان مهم اصول‌گرا، وجود مشاكلت‌ها و احياناً تأثير و تأثّرهايي را ميان آنها آشكار مي‌سازد. مواجهه‌ اين دو جريان با فرآيند اجتهاد، نفي عقلانيّت در ساحت احكام، غيرموّجه دانستن استدلال ها و براهين عقلي در فهم شريعت و تكيه ي كامل بر روايات، از مهم¬ترين مواردي است كه ميان آن دو به نوعي همگن و متجانس مي‌نمايد. در اين پژوهش، تلاش شده است تا گوشه هايي از مشابهت هايي اين دو جريان، به ويژه در نوعِ نگاهي كه به عقل دارند، مورد تأمّل و بررسي قرار گيرد.

The history of Islamic jurisprudence has witnessed two heterogeneous yet apparently similar trends – although in two different periods of time and manifestations. One is the Akhbariyya movement in Imami school, which, with a new approach to practicing sharia and while negating ijtihad (legal reasoning), regards intellect as being unable to achieve legal rulings. The second trend is the Salafiyya among the Sunnis, which, although a basically ideological trend and not merely a jurisprudential movement, has specific views in the field of jurisprudence and religious law largely similar to those of the khbariyya. An in-depth deliberation on the doctrines, major approaches, and methodology of these two important fundamentalist trends will reveal the existence of conformities and possibly certain interactions between them. The confrontation of these two trends with the process of legal reasoning, negation of rationality in the domain of ordinances, regarding the reasoning and rational arguments as unjustified in understanding religious law and complete reliance on traditions are among the issues that seem to be homogenous and consistent between the two. It is attempted in this research to survey and ponder on some instances of the similarities of these trends, particularly their view on intellect
