حق گردشگري و حقوق عمومي گردشگران خارجي

توسعه صنعت گردشگري در هر كشوري بستگي كامل به تامين زيرساخت‌هاي اساسي آن مانند هر صنعت ديگر دارد. يكي از بنيادي‌ترين اصول آن، شناختن حق گردشگري به انسان از جمله گردشگران خارجي مي‌باشد. امروزه، اين حق به عنوان يكي از حقوق اساسي بشر شناخته شده و برخورداري از اين حق در حقوق داخلي و نيز اسناد بين‌المللي مورد تاكيد قرار گرفته است. به علاوه لازمه اجراي حق گردشگري، شناسايي حقوق مهمه ديگري تحت عنوان حقوق و آزادي‌هاي اساسي بشري است زيرا هر گاه انسان از حق گردشگري به عنوان يك حق فطري برخوردار باشد ولي اجازه ورود و اقامت در كشور ديگر نداشته باشد و جان و مال او در كشور محل اقامت در امان نباشد و در صورت تعرض به جان و مال او، اجازه مراجعه به دادگاه‌هاي آن كشور و دفاع از حق خود نداشته باشد حق گردشگري بي‌معنا خواهد بود. به اين دلايل است كه در هر كشوري در جهت شناسايي و تامين اين حقوق اساسي مقررات ويژه‌اي به تصويب مي‌رسد و در كشور ما نيز اين حقوق و آزادي‌ها تا آنجا كه لازمه شخصيت يك انسان است براي گردشگران خارجي به رسميت شناخته شده است.

The development of tourism industry like any other industry in every country is dependent upon its infrastructures. Recognizing the tourism right is one of the fundamental principles for human beings especially for foreigners. Nowadays, this right is one of the basic human rights known in the world and emphasized in the national rights and international documents. Furthermore, the necessity to perform tourism right is recognizing other rights including rights and basic freedom of human beings. If a person has the tourism right as his/her natural right but has not the right to enter or stay in another country and his/her property (money) or life in the target country be not safe, or in case of any offence against his her life or property (money) has not the right to refer to the court and defend his right. Then the concept of tourism right will be futile and in vain. It is because of this matter that in every country, there are special approved regulations to recognize and provide these basic rights. In our country, Iran, these rights and freedom have been recognized and approved for foreign nationalities and tourists as far as the human beings, personality are concerned.
