حريم خصوصي در پژوهش‌هاي معطوف به انسان بر مبناي آموزه‌هاي اسلامي

Privacy in Research on Human Subjects Based on the Islamic Teachings

حريم خصوصي از مباحث مهم و عام اخلاق است كه در حوزه اخلاق حرفه‌اي به ويژه اخلاق پژوهش چالش‌هاي فراواني را ايجاد كرده است. همچنين تحولات علمي باعث شده‌اند كه انسان و سوژه انساني در معرض پژوهش‌ها وآزمون‌هاي مختلف قرارگيرد و به لحاظ پيشرفت‌هاي فني نيز امكان دسترسي، ذخيره و بازيافت حجم انبوهي از اطلاعات ميسر شده است. از جمله مهم‌ترين پژوهش‌هاي معطوف به سوژه انساني مي‌توان از تحقيقات باليني پزشكي، بررسي‌هاي ژنتيكي، مطالعات روان‌شناختي، علوم اجتماعي، علم كلام و الهيات نوين و پژوهش‌هاي اخلاق كاربردي نام برد. در اين مقاله پس از بررسي مفهوم حريم خصوصي، با نظر بر پژوهش‌هاي معطوف به سوژه انساني، معضله حريم خصوصي در فرايند پژوهش براساس آموزه‌هاي اسلامي مورد تحليل قرار مي گيرد. در حالت معمول، حق افراد بر صيانت از حريم خصوصي‌شان نبايد در تعارض با تحقيق قرار گيرد، چرا كه اصل بر اين است كه اطلاعات و يا نمونه‌هاي گرفته شده از افراد به ضرر خودشان استفاده نمي‌شود. ولي در شرايطي كه اين اطلاعات يا نمونه‌ها در تحقيقاتي به كار رود كه از تسلط فرد خارج است، ممكن است محدوديتي براي حفظ حريم خصوصي ايجاد كند كه اين امر با اخذ رضايت آگاهانه از فرد و يا با سياست‌هاي حفاظتي موسسه‌هاي پژوهش قابل جبران است. به هر روي مهم‌ترين عامل در حفظ حريم خصوصي تقوي و پارسايي محقق است.

Privacy is among significant general issues of ethics which has created lots of challenges in the field of professional ethics, particularly in the field of ethics in research. Scientific developments have exposed human beings and human subjects to different investigations and tests, while due to technical advancements, access, storage and retrieval of a great volume of data has become possible. Among the most important researches related to human subject one may mention medical clinical studies, genetic, psychological, social and modern theological studies and applied ethical investigations. The present article is an attempt to study the concept of privacy within the studies related to human subject and the problem of privacy in the process of research. Islamic teachings. Under normal circumstances, the people’s right to protection of their privacy should not contradict research, for basically it is understood that the data or the sample taken from the people is not used against them. But when these data or samples are used in the studies which are out of control of the people, it may infringe upon their privacy which can be compensated through getting the conscious consent of the concerned person or through protective policies of the research institute. However, the most important factor in protection of privacy is the piety and virtue of the researcher.
