From Informed Consent to Knowingly Choosing: A Study on the Commitment to Information Delivery in Physician- Patient Relationship

اطلاع‌رساني به بيمار از جمله شاخص‌ترين تعهدات پزشك در برابر بيمار مي‌باشد. پزشك بايد بيمار را نسبت به تشخيص خود در مورد بيماري، ماهيت و محدوده عمليات پزشكي پيشنهادي و عواقب و خطرات احتمالي ناشي از آن و مسايلي از اين دست آگاه نموده و اطلاعات صحيح و كاملي در اين خصوص در اختيار وي قرار دهد تا او بتواند با رضايت كامل و آگاهانه راجع به آنچه نسبت به جسم وي صورت مي‌گيرد، تصميم‌گيري نمايد. عدم رعايت اين تكليف از سوي پزشك مي‌تواند نوعي تقصير حرفه‌اي از سوي وي محسوب شده و نهايتاً مسيوليت او را در پي داشته باشد. در مقاله حاضر در پي بررسي ابعاد مختلف تعهد پزشك به اطلاع‌رساني با نگاهي تطبيقي به نظام‌هاي حقوقي كشورهاي ديگر در مقايسه با نظام حقوقي ايران هستيم.

Delivering information to the patient is one of the most significant of a physician’s commitments. The physician should inform the patient about his or her diagnosis about the disease, nature and scope of medical practices, consequences and possible risks and something like these. The physician should also help the patient access correct and sufficient information in this regard so that s/he can make decision knowingly about what will be done to his/her body. Failure to accomplish this commitment can be considered as a professional failure and finally, leads to his/her responsibility. The author of the present article tries to study different aspects of a physician’s commitment to inform patients with a comparative view to legal systems of countries other than Iran.
