The Emergence and Evolution of Japanʹʹs System for Industrial Property Rights

تاثير حقوق مالكيت فكري بر نوآوري و عملكرد اقتصادي پيچيده است و دقت در طراحي نظام مالكيت فكري به نحوي كه بتواند به عنوان ابزار سياستي موثري در توسعه اقتصادي استفاده شود، ضروري است. در طراحي اين نظام‌ها، كشورهاي مختلف بسته به شرايط داخلي و محيط جهاني مسيرهاي متفاوتي را مي‌پيمايند. از اين رو، ارزيابي‌هاي مقايسه‌اي و محك‌زني، در بيشتر پژوهش‌هاي سياستي مورد استفاده سياستگذاران قرار مي‌گيرد. اين مقاله به همين منظور به مطالعه موردي مراحل تكامل نظام مالكيت صنعتي در ژاپن پرداخته و در انتها شامل توصيه‌هايي جهت طراحي استراتژيك اين نظام در ايران است. ژاپن در مراحل اوليه توسعه خود از نظام حقوقي مالكيت صنعتي سود فراواني برده است. يادگيري فناورانه در ژاپن به پشتيباني "نظام ضعيف مالكيت صنعتي" صورت گرفت. اين نظام ضعيف، جذب نوآوري و دانش برون مرزي توسط بنگاه‌هاي داخلي را تسهيل كرد. ابتكاراتي نظير ثبت "مدل‌هاي سودمند" و "طرح‌هاي صنعتي" نه تنها فرهنگ ثبت اختراع را در اين كشور توسعه داد بلكه مشوقي قوي براي نوآوري‌هاي تدريجي و بهبودهاي حداقلي بر پايه اختراعات خارجي شد. زماني كه قابليت‌هاي فناورانه بنگاه‌هاي داخلي افزايش يافت و بنگاه‌ها خواستار رژيم حفاظتي قويتر براي اختراعات خود شدند، نظام حقوق مالكيت فكري ژاپن تقويت شد به طوري كه در حال حاضر يكي از سخت‌ترين و كامل‌ترين نظام‌هاي IPR جهان به شمار مي‌آيد.

The influence of the intellectual property rights on the innovation and economical performance is a complicated type and it is necessary to be precise while designing the IPR system which might be applicable for the economic development as an effective instrumental policy. While designing such systems, different countries go through different paths depending on the local context and the global environment. Thus, comparative assessment and benchmarking is widely used in most studies of policy-making. This article deals with case study evaluation of evolution procedures of IPR in Japan and at the end, it encompasses some suggestions for strategic design of this system in Iran. Japan has greatly benefited from its preliminary phases of development of the IPR. Technological learning in Japan has been established in support of a fragile system of IPR. This system paved all the way for absorbing innovation and beyond boundaries knowledge by the local firms. Some initiatives such as "profitable models" and "the industrial plans" not only developed the patent culture in this country, but also it turned into a strong driving force for the incremental innovations and partial improvements based on the foreign ones. While the technological capabilities of the local agencies were increasing, and the firms were requesting for a stronger protective regime for their own inventions, Japan intellectual property rights system was reinforced in such a manner that presently it is considered as one of the strictest and complete IPR systems in the world.
