• Imam Khomeini and His Innovations in Political Fiqh

Imam Khomeini is mainly characterized with his knowledge of fiqhi affairs. This article focuses on his fiqhi innovation. Islamic fiqh is a very vast ocean of religious knowledge, and so the authorʹs main concern in this article is about the question of political fiqh. Late Imam Khomeiniʹs fiqhi innovation is a type of epistemological and structural change in faqihsʹ current understanding of the issue of wilayat al-faqih (guardianship of the jurist). In the current understanding of this issue no separate discussion could be detected and the question of guardianship of the jurist could not be found as an issue of special significance, but in the view of Imam Khomeini this issue is given priority and considered among the primary injunctions such as praying, fasting, hajj or even more significant than the mentioned injunctions. To maintain legality and justify its measures, a government in itself and in essence has expedience and it requires a kind of expedience other than its own expedience. This new perception of government manifested itself very clearly more and more in the earlier time when the Islamic government was founded. In his discussion of Imam Khomeiniʹs innovation in political fiqh, the author refers to some points that do not resemble those adopted by great religious scholars.
