Anti-Counterfeiting Trade Agreement and its Relationship with Internet

مقدمه: معاهده‌ي ضد تجارت جعلي (Anti-Counterfeiting Trade Agreement يا ACTA) معاهده‌اي است كه في مابين بسياري از كشورهاي صنعتي جهان و در راس آن‌ها آمريكا منعقد شده است. كشورهاي صنعتي بزرگ و در راس آن‌ها آمريكا، همواره تلاش داشته‌اند كنترل اين سازمان تجارت جهاني را به طور كامل در دست بگيرند. اگر چه اين كشورها به ميزان زيادي در اين راه موفق بوده‌اند، ولي همواره از عملكرد آن و آراي مخالفان خود در مجمع سازمان ناراضي و درصدد راهي براي دور زدن اين سازمان بوده‌اند. در اين رابطه دو كشور آمريكا و ژاپن با تهيه‌ي پيش‌نويس اوليه‌ي ACTA از سال ???? تلاش‌هاي محرمانه‌ي خود را جهت ايجاد استاندارد جهاني جديدي كه فراتر از قوانين سازمان‌هاي موجود و مستقل از قدرت كشورهاي مختلف باشد، شروع كردند. اين معاهده در زير پوشش مبارزه با جعل كالا درصدد تحقق بخشيدن به حق مالكيت معنوي يا حق كپي رايت است و با اين بهانه سعي در كنترل كامل ارتباطات اينترنتي دارد. در‌ واقع اين سازمان سعي در ايجاد حكومتي جديد در خارج از مرز تمام كشورها، ولي حاكم بر قوانين تمام كشورهاي عضو دارد؛ تا بدين وسيله بتواند كنترل كامل اينترنت را در دست بگيرد. اين مقاله سعي در روشن كردن اهداف پنهان اين معاهده و ارتباط آن با اينترنت دارد. واژه‌‌هاي كليدي: معاهده‌ي ضد تجارت جعلي، كپي رايت، حق مالكيت معنوي، اينترنت، داروهاي جعلي.

Abstract Introduction: Anti-counterfeiting trade agreement (ACTA) is a plurilateral agreement among industrialized countries including USA. Top industrialized countries and in particular USA always tried to have complete control over world trade organization (WTO). Although they had many success for their purpose, they are not convinced about the WTO functions and they can not tolerate critiques of their opponents in WTO, so they were looking for a way to bypass the WTO. In 2006 Japan and USA prepared an initial proposal and tried confidentially to attract other industrialized counties into their agreement. Under the cover of fighting good counterfeit, this agreement aimed to legally enforce the intellectual property rights and total control over Internet communications. They aimed for new standards and system of laws independent of existing international organizations and countries to establish a new governing body outside of the body of existing countries. All these efforts were to forcibly implement the intellectual property right and copyright law by implementing total control on the Internet as the main media for copyright infringement. This article has been written to shed some light on the issue and disclosing the hidden parts of this agreement.
