راهبرد جمهوري اسلامي ايران درخصوص تقويت حقوق مخاصمات مسلحانه بين‌المللي

The Islamic Republic of Iran Strategy with regard to the strengthening International Armed conflicts Law

حقوق مخاصمات مسلحانه با قبول واقعيت جنگ به كاهش آلام انسان ها مي‌انديشد و به محدود كردن آثار ناشي از جنگ مي‌پردازد، لكن رفتار قدرت هاي استعماري افق روشني را در حفظ و رعايت حقوق بشردوستانه نشان نمي‌دهد. فرهنگ‌سازي و تكيه بر ارزش هاي انساني و ديني اميد به آينده را در انسان ها زنده مي‌كند. با هدف ارايه راهبرد مناسب براي تقويت حقوق مخاصمات مسلحانه با برخورداري از منابع غني اسلامي، با به كارگيري روش تحقيق زمينه‌اي – همبستگي و با استفاده از ابزار پرسشنامه و برخورداري از نتيجه مصاحبه‌هاي انجام شده و بررسي اسناد و مدارك كتابخانه‌اي معلوم مي‌گردد كه منابع اسلامي سرشار از دستوراتي درخصوص آغاز نكردن جنگ، رعايت حقوق اسرا ، عدم تعرض به كساني كه سلاح ندارند و عدم تعرض به غير نظاميان، زخمي شدگان، زنان، كودكان و افراد سالخورده و حفاظت از محيط زيست مي‌باشد. درنتيجه ثابت مي‌شود كه جمهوري اسلامي ايران با پاي بندي هرچه بيشتر و مشاركت موثر در اجراي حقوق بشردوستانه و حضور رسمي و قدرتمند در جلسات و كنفرانس هاي بين‌المللي و جلوگيري از يك‌جانبه گرايي قدرت هاي استعماري، مي‌تواند موجبات تقويت اين رشته از حقوق بين‌الملل را با تكيه بر مفاهيم اسلامي فراهم آورد.

The law of armed conflicts takes care the assuage of sufferings of human beings with acceptance of the reality of war and is also concerned with the limitation of the consequences of war. But، the behaviors of colonial powers do not show clear horizon in maintaining and observing humanitarian Law. Culture making and reliance on religions and human values; revive the hope to the future among human beings. With the aim at presenting a suitable strategy for strengthening the International armed conflicts Law، by enjoying the rich Islamic Sources، with usage of solidarity-background research method، by using questionnaire tools and conducted interviews and Library documents and deeds، we have come to this conclusion that Islamic sources are full of orders for non initiating the war، observing the rights of prisoners of war، non-violence against unarmed people and non-violence against civilians، wounded، women، children، the aged and protection of environment. As a result، it is proved that by further abiding by and effective participation for implementing humanitarian Law and by powerful and official presence in the international conventions and meetings and for prevention the unilateralism of colonial powers، the Islamic Republic of Iran could strengthen this field of International law with reliance on Islamic Concepts
