"Discrimination against Children" Understanding the Concept and Providing the Definition Through a Comparative Study of the International Human Rights Instruments

به‌رغم آنكه اصطلاح «تبعيض» به طور عام و «تبعيض عليه كودكان» به طور خاص بسيار پركاربرد هستند اين دو نه در اعلاميه جهاني حقوق بشر تعريف شده‌اند، نه در ميثاقين و نه در پيمان‌نامه حقوق كودك؛ امّا اين به معناي فقدان تعريفي، هر چند اجمالي از اين اصطلاح در اسناد بين‌المللي حقوق بشر نيست. در اسناد متعددي كه براي مقابله با تبعيض در قلمروها و موضوعات خاص تدوين شده‌اند، تعاريفي براي اصطلاح تبعيض، البّته از همان منظر ارايه شده است. از مقايسه و انتزاع قدر جامع اين تعاريف مجزا و سپس الغاي خصوصيت‌هاي آن تعاريف، مي‌توان به تعريفي كلّي- كه بشود ادعا كرد مقبول نظام بين‌الملل حقوق بشر است- دست يافت. مقاله حاضر نخست مروري دارد بر تعريف اصطلاح «تبعيض» در اسناد خاص حقوق بشري؛ سپس نقش نهادهاي نظارتي حقوق بشري در تبيين اصل عدم تبعيض مطالعه را مي‌كند و در نهايت براي اصطلاح «تبعيض عليه كودكان» تعريفي پيشنهاد كرده، اجزا و قيود چهارگانه آن تبيين مي‌كند.

Despite the fact that the terms "Discrimination" in general and "Discrimination against Children" in particular are very widely used, these two terms are not defined in the Universal Declaration of Human Rights (UDHR), International Covenant on Civil and Political Rights (ICCPR), International Covenant on Economic, Social and Cultural Rights (ICESCR) nor in the Convention on the Rights of the Child (CRC).But this doesnʹt mean that there isnʹt any definition, although general/ imprecise one, of these terms in the international human rights instruments. In different and various documents that deal with discrimination in specific concepts and certain issues have developed as well as various definitions of the term "Discrimination" but from the same perspective are presented. Through a comprehensive comparison, and much abstraction and then abolish the separate definitions of the feature definitions, can be the general definition - that credit can be claimed by international system of human rights-achieved. This article will first review definitions of the term "Discrimination" in particular human rights documents, then explore the role of human rights supervisory institutions, in explaining the principle of non-discrimination and will finally proposes a definition for the term "Discrimination against Children" and explain the four components and constraints of this proposed definition.
