Human Cloning Fiqhi Decrees and Legal Consequences

همانندسازي انسان و احتمال ايجاد نسلي بدون لقاح اسپرم و تخمك از جمله مسايل مستحدثه (نوظهور) در فقه است كه احكام آن بررسي بيش‌تري مي‌طلبد. جواز يا حرمت همانندسازي توليدي،‏ نسب ناشي از اين عمل،‏ احكام مربوط به نكاح،‏ حق ارث و حضانت كلون (همانند)،‏ به صورت استدلالي،‏ محورهاي اصلي بحث اين مقاله مي‌باشند. بر خلاف اهل تسنن،‏ بيش‌تر علماي شيعه معتقدند كه همانندسازي ذاتا جايز است،‏ گرچه ممكن است انجام دادن آن در سطح گسترده،‏ به لحاظ تبعات منفي،‏ ممنوع گردد. در همانندسازي صورت‌هاي مختلفي مفروض است و با توجه به عوامل دخيل در قرابت ممكن است روابط نسبي متفاوتي ايجاد نمايد. احكام نكاح،‏ حق ارث و حضانت كلون‌ها تابع اثبات رابطه نسبي بين كلون و عوامل دخيل در تكون آن است. در فرض عدم اثبات قرابت،‏ رعايت جانب احتياط،‏ بويژه در نكاح،‏ رجحان دارد.

Human cloning and the possibility of reproducing a human being without fertilizing the egg with the sperm is one of the new questions in Fiqh which need more discussions. The permissibility or the prohibition of reproductive cloning, parentage of the clone, the rules of the Shariʹah regarding marriage, inheritance and the custody of the clones, along with the study of the reasons of the rules are the main concerns of this work. Unlike the Sunnis, most of the Shiʹi jurists believe that human reproductive cloning is permissible, although its wide application is forbidden because of some harmful effects. Various cases are imaginable for human cloning and by considering the effective factors in ancestry, it may result in different relationships. Family law, the right of inheritance and the custody of the clones are subject to the parentage establishment. Even if the relationship couldnʹt be proved, a precaution, specifically in marriage, is preferred
