در مورد وضعيت حقوقي اطفال متولد از تلقيح مصنوعي مباحث فراواني قابل طرح و بررسي است. اين در حالي است كه تنها قانوني كه در اين مورد وضع گرديده، قانون «نحوه اهداي جنين به زوجين نابارور» است كه در پنج ماده تنظيم گرديده و بسياري پرسش‌ها در اين زمينه را بي‌پاسخ گذارده است. يكي از مباحث حقوقي مطرح در مورد چنين اطفالي، بحث تابعيت آن‌هاست. در اين مورد حكم خاصي از سوي قانونگذار وضع نگرديده و تابعيت اين اطفال را به موجب قواعد عمومي تابعيت، بايد تعيين نمود. با اعمال قواعد عمومي تابعيت، در مواردي ممكن است تابعيت طفل با زوجين اهداگيرنده متفاوت باشد. اين تفاوت، جامعه، طفل و زوجين اهداگيرنده را با مشكلاتي روبه‌رو خواهد كرد. در نهايت پيشنهاد مي‌گردد با توجه به آزادي دولت‌ها در تعيين اتباع خود، قانونگذار ايران به چنين اطفالي تابعيت ايران را اعطا نمايد.

There are so much discussable issues about legal statues of the kids born of artificial insemination. This is while the only law that had been set about this issue is "the ways of presenting Fetus to the infertile couple law" that had been conducted in 5 articles and had left so many unanswered questions in this subject. One of the legal considered subjects about these kids is their nationality. There isnʹt any special passed law by the lawmaker and these kids’ nationality should be determined based on the public regulations. By exerting the public rules of nationality in some cases there might be some differences in kid’s nationality with the recipient couples. This difference makes troubles for the community, kid and the recipient couple. Eventually it is recommended considering the states freedom in determining their subjects; Iran’s law maker gives these kids Iranian nationality.
