بررسي فقهي‌ـ حقوقي مالكيت فكري با رويكردي به نظر امام خميني(س)

A Jurisprudential –Legal Study of Intellectual Property Right With Special Reference to Imam Khomeiniʹs Viewpoints

: فقيهان در مورد مشروعيت حقوق مالكيت فكري اختلاف نظر دارند. به نظر برخي فقيهان اين گونه حقوق به دلايلي چون ناسازگاري آن با قاعده سلطه، عدم امضاي چنين حقوقي از سوي شارع، ناسازگاري آن با رسالت و قداست علم و غير قابل تملك شخصي بودن اين دسته از حقوق، حقوقي شرعي محسوب نشده و اشخاص ثالث مي‌توانند بدون اجازه صاحبان اثر در آن تصرف كنند. به نظر برخي ديگر، چنين حقوقي شرعيت داشته و تصرف در آنها بدون اجازه صاحبان آنها جايز نيست. ادله اين گروه عبارتند از: بناي عقلا، قاعده سلطه، حرمت تصرف در اموال ديگران بدون اجازه آنها، قاعده لاضرر، راهكار ولايت فقيه، مصالح مرسله و سدّ ذرايع كه دو دليل اخير اختصاص به فقه اهل سنّت دارد.

There are differences of opinion among the jurists about legality of intellectual property rights. Some jurists maintain that such rights are not legal due to the following reasons: their incompatibility with the rule of domination, lack of acknowledgement of such rights by the Law-Giver, their incompatibility with the mission and sanctity of science and lack of personal possession. Hence, they maintain that third persons can use them with any permission from the proprietors. Some other jurists maintain that such rights are legal and that one should not use them with the permission of the proprietor. They argue that the following reasons support their viewpoints: reason, rule of domination and Wilayat Faqih. The Sunni jurists also forward two reasons in support of this viewpoint.
