The Requirements of the application of the Convention on the Contract for the International Carriage of Goods by Road (CMR)

نقش مهم حمل و نقل در گردش كالا و توزيع ثروت در عرصه بين‌الملل، تصويب مقررات يكنواخت بين‌المللي را ضروري گردانيده است. در اين ميان، يكي از كنوانسيونهاي داراي اهميت، كنوانسيون راجع به قرارداد حمل و نقل بين‌المللي كالا از طريق جاده معروف به CMR است. جمهوري اسلامي ايران نيز به دليل آثار مهم اقتصادي ناشي از پيوستن به كنوانسيون، به اين كنوانسيون ملحق گرديده است. به‌رغم گذشت بيش از 14 سال از تاريخ الحاق به اين كنوانسيون، ادبيات حقوقي ايران از غناي كافي در اين خصوص برخوردار نيست. از آن جايي كه اعمال كنوانسيون بر قرارداد حمل و نقل بين‌المللي كالا مستلزم وجود شرايطي است، اين جستار درصدد تبيين شرايط مزبور از حيث ماهيت، شرايط مربوط به تشكيل قراردادهاي مشمول كنوانسيون، عناصر لازم براي تحقق وصف بين‌المللي حمل و نقل و شرايط مربوط به اعمال كنوانسيون بر اساس قواعد حل تعارض است.

The important role of the transportation of goods and distribution of the wealth in the international scope has necessitated the enactment of unified international provisions. One of these important conventions is the Convention on the Contract for the International Carriage of Goods by Road (CMR). Islamic Republic of Iran, due to the important economic effects of joining this Convention, has joined it. Although the joining has occurred more than fourteen years ago, the Iranian legal literature is not so rich in this area. Since the application of the Convention on the contract of international carriage of goods requires some conditions, this study is going to explain those conditions with respect to their nature, the conditions of the conclusion of the contracts covered by the Convention, the necessary elements required for the ʹinternationalʹ description of the carriage and also conditions of the application of the Convention on the basis of the rules of conflicts of laws.
