Jurisprudence and Mysticism Necessity of a Mystical Approach to Jurisprudence and Quranic Verses on Commandments

چكيده: هرچند بحث از رهيافت عرفاني به باطن قرآن و لايه‌هاي دروني معاني آيات از گذشته دور تاكنون، مورد اهتمام عالمان مسلمان به ويژه عرفا بوده و متون و منابع قابل توجه به جا مانده از عرفا چه با عنوان تفسير، يا تاويل و يا عناوين ديگر شاهد اين مدعاست؛ اما سخن از رابطه فقه و عرفان و رهيافت عرفاني به آيات الاحكام قرآن كه اساس احكام فقهي را تشكيل مي‌دهد از عمري طولاني برخوردار نيست. موضوع شريعت، طريقت و حقيقت در عرفان اسلامي نيز به طور روشن در مقايسه با همين بحث نسبت فقه و عرفان تبيين مي شود. پژوهش پيش رو مي‌كوشد ضمن بحث از اصل ضرورت رهيافت عرفاني به فقه و آيات فقهي، برخي دلايل، قراين و شواهد آن را تبيين كند. اين موضوع ازآن رو اهميت مضاعف مي‌يابد كه برخي آيات فقهي را آيات محكم دانسته و چنين رهيافتي به آن را جايز نمي‌شمارند. درحالي كه دقت در شيوه قرآن در بيان احكام، تمايز ميان مقام اسلام و ايمان از نظر قرآن و نيز ترجيح جنبه باطني بر جنبه ظاهري دين در اديان مختلف، بيانگر لزوم رهيافت عرفاني به آيات الاحكام قرآن است.

Abstract: Although the issue of mystical approach to the inner layers of the Quran and meanings of its verses has been a focal point of discussions of the Muslim scholars, particularly the mystics since old times and considerable works have been inherited from the mystics either as exegesis or interpretation or other subjects, the issue of relationship between jurisprudence and mysticism and mystical approach to the verses of the Quran which constitute the foundation of jurisprudential decrees is relatively a new issue. The subjects of Sharia, wayfaring and truth in Islamic mysticism too is clarified in comparison with the very issue of relationship between jurisprudence and mysticism. The present paper is an attempt to discuss the necessity of a mystical approach to jurisprudence and jurisprudential verses and their reasons, circumstantial evidences and proofs. This issue is important because some thinkers consider some of the Quranic verses as clear ones and do not permit such an approach to those verses. While reflection on the Quranic method in expression of commandments, distinction between the status of Islam and status of belief in Quranic perspective and also the preference of inward aspect of religion to its outward in different religions underline the necessity of a mystical approach to the Quranic verses on commandments.
