Nawazilnegari and Social History: A Case Study of the Social Position of Maghreb Women Based on Nawazil Wansharisi

تاريخ اجتماعي، به عنوان يكي از عرصه‌هاي مهم و نوين در پژوهش‌هاي تاريخي، كمتر مورد توجه قرار گرفته است. در چند دهه اخير، آثاري در اين زمينه، به طور عام، و در حوزه تاريخ اسلام، به طور خاص، به رشته تحرير درآمده است. يكي از منابع مهم مطالعه تاريخ اجتماعي مغرب، كتاب‌هاي نوازل است كه در قرن سوم، در مغرب و اندلس به نگارش درآمدند. اين كتاب‌ها، گرچه در اصل، در زمره آثار فقهي محسوب مي‌شوند، اما داده‌هاي مهمي را در باب تجارت، رفتارها و آداب جامعه، تعامل حكومت و مردم، اوضاع ديني، علمي و فرهنگي روزگار مولف، در خود منعكس كرده‌اند كه نمونه هاي آن را به دشواري مي‌توان در منابع ديگر يافت. در ميان اين نوشته‌ها، المعيار المعرب ونشريسي به دليل اشتمال بر فتاواي متعدد مربوط به زنان و اطلاعات ارزشمندي كه از زندگي، ازدواج، كار و موقعيت اجتماعي آنها به دست مي‌دهد، از جايگاه ويژه‌اي برخوردار است. اين مقاله مي‌كوشد تا با تكيه بر داده‌هاي اين كتاب:جايگاه زنان مغربي را مورد بررسي قرار دهد.

Social history is one of the major branches of historical research which has rarely received due attention. Only recently, some related works have been devoted to this domain in general and to the field of Islamic history in particular. One of the main sources for the study of Maghreb social history is Nawazil books, created in Andalusia and Maghreb in the third century. Although these books are mainly classified as books of the jurisprudence, yet, they include important information on issues of commerce, social etiquettes, the relationship between government and subject people, as well as religious, scientific and cultural conditions of the time of the author. Such kinds of information can rarely be found in other sources. Among other books, Nawazil Wansharisi is of great importance since it includes numerous women-related Fatawa and valuable information about women’s life, marriage, occupation and social status. This study attempts to present a short introduction to Nawazil negari plus a survey on the place and position of Maghreb women.
