Polygamy

چندزني يا تعدد زوجات واقعيتي اجتماعي است كه ابعاد گوناگون آن مي‌تواند مورد مطالعه و پژوهش قرار گيرد. در اين مقاله مباني مشروعيت تعدد زوجات، شرايط و آثار آن در حقوق اسلامي بررسي شده است. اگرچه اصل جواز تعدد زوجات براساس آيات و روايات معتبر و سيره قطعيه متشرعه مورد اجماع و اتفاق همه مذاهب اسلامي است، ولي پرسش‌هاي جدي درباره خصوصيات اين حكم و شرايط اجراي آن وجود دارد. به‌رغم برخي ديدگاه‌ها در ميان انديشمندان اسلامي، اباحه تعدد زوجات به حالت ضرورت و شرايط خاص اجتماعي اختصاص ندارد. رعايت عدالت ميان همسران تنها شرط مورد اتفاق در انتخاب چندزني است؛ اگرچه در مفهوم و مصاديق عدالت، ديدگاه‌هاي گوناگوني وجود دارد. شرايط ديگر همانند رضايت همسر اول يا تمكن مالي نمي‌تواند از شرايط مبادرت به چندهمسري باشد و ادله جواز آن از اين حيث اطلاق دارند. اگرچه حكومت اسلامي بنا بر مصالح اجتماعي و به‌عنوان حكم حكومتي نمي‌تواند قيود و شرايط يا محدوديت‌هايي در اين باره وضع كند.

Polygamy is a social reality which may be studied in various respects. In the present article, foundations of legitimacy of polygamy, its conditions and effects in the Islamic Law will be studied. Though all Islamic schools accept permissibility of polygamy based on verses, valid hadiths, and the tradition of jurists, there are serious questions about properties of this verdict and circumstances under which it may be executed. In spite of some views popular among Muslim thinkers, permissibility of polygamy is not specific to the state of necessity and particular social conditions. To observe justice between wives is the only condition which is agreed upon concerning polygamy; though about the concept and instances of justice, there are various views. Other conditions such as agreement of the first wife or financial ability cannot be among conditions for polygamy; and reasons for its permissibility are too general to be restricted in this respect. Though, Islamic government may, because of social interests, impose as a State verdict, some conditions or limitations in this regard.
