تجارت الكترونيكي به‌واسطه تحقق در بستر فناوري‌هاي اطلاعات و ارتباطات، از ويژگي‌هاي خاصي برخوردار است كه شناخت دقيق آنها به درك بهتر اين پديده و مواجهه مطلوب‌تر با چالش‌هاي جديدي كه فراروي جوامع امروزين در عصر فناوري اطلاعات و ارتباطات گسترده است، كمك خواهد كرد. اين نوع از تجارت به شيوه‌هاي گوناگوني انجام مي‌پذيرد و روش پرداخت بهاي كالاها و خدمات و حتي روش در يافت آنها نيز تفاوت‌هاي بنياديني با تجارت سنّتي دارد. الكترونيكي‌بودن روش تحقق اين رابطه تجاري نيز طرفين رابطه را ناگزير مي‌سازد كه با دقت و اهتمام بيشتري نسبت به انجام معاملات تجاري اقدام كنند. رعايت شرايط ايمني و تدابير امنيتي از مهم‌ترين ضروريات تجارت الكترونيكي است كه نظارت و توجه روزافزون كاربران و حاكمان را مي‌طلبد. آشنايي جامعه حقوقي با اين تجارت نيز از ضروريات عصر حاضر است و بسيار راهگشا خواهد بود. هدف از اين نوشتار، تبيين ويژگي‌هاي اختصاصي تجارت الكترونيكي به‌گونه‌اي است كه مرز ميان تجارت سنّتي و الكترونيكي نمايان شود و پس از بيان انواع تجارت الكترونيكي كه امروزه رواج عملي دارد، شيوه‌هاي كارسازي الكترونيكي عمليات تجاري، همراه با حفظ امنيت مبادلات و پرداخت‏هاي الكترونيكي معرفي خواهد شد.

Since it is practiced in the context of information and communication technologies, e-commerce has particular properties which, if known accurately, this phenomenon may be understand in a better way, and this knowledge will help us to face new challenges encountered by the contemporary societies in the age of technologies of information and communication. This kind of commerce is practiced in various ways; and payment for goods and services and even delivery of goods and services are made in ways which are fundamentally different from those used in the traditional commerce. This commercial relation is realized in an electronic way, and this makes two parties to perform their commercial transactions more carefully. To observe principle of security and to adopt security measures are among most important necessary aspects of e-commerce, calling for ever-increasing supervision of the statesmen and users.Familiarity of the juridical society with this kind of commerce is one of the necessities of the present time, and it will solve many problems. The present writing is aimed to explain particular properties of e-commerce in such a way that the border between traditional commerce and e-commerce may be revealed. Having described kinds of e-commerce which are today popular, the author will introduce ways to perform commercial operations in an electronic way while securing electronic transactions and payments.
