جامعه‌شناسي تحول خانواده در ايران (بررسي ابعاد اجتماعي و حقوقي لايحه حمايت خانواده)

Sociology of the Family’s Evolution in Iran (The Study on Legal and Social Aspects of the Bill on Family Protection)

تحولات جامعه در انگاره‌هاي فرهنگي و ساختارهاي جماعتي- سنتي ازجمله روابط خويشاوندي، گستره فضاي عمومي و فضاي خانگي و فرديت دگرگوني‌هايي را پديد آورده؛ تحولاتي كه خانواده را دستخوش تغيير كرده و حقوق خانواده، زنان، مردان و كودكان را نيز تحت تاثير قرار داده است. مقاله پيش‌رو درپي آن است تا از دريچه لايحه حمايت از خانواده، تحولات خانواده را از دو منظر جامعه‌شناسي و حقوقي بررسي و ارزيابي كند. در فصل نخست مقاله (بعد جامعه‌شناسي)، تغيير نقش و جايگاه در خانواده معاصر ايراني مورد توجه قرار مي‌گيرد و از خلال تحولات اخير، نقش و جايگاه زن، مرد و فرزند بررسي مي‌شود. در فصل دوم (بعد حقوقي)، امتيازها، ايرادها و كاستي‌هاي لايحه با نگاهي به تحولات جامعه‌شناسي ارزيابي مي‌شود. در نهايت، با توجه به داده‌هاي حقوقي و جامعه‌شناسي، ميزان تطابق لايحه حمايت از خانواده با تحولات موجود و امكان پاسخ‌گويي آن به مسايل و مشكلات كنوني خانواده واكاوي مي‌شود.

The institution of family has faced important evolutions in recent decades. Transition from traditional society to modern one has caused changes in cultural and social imaginaries and structures. Recent evolutions have affected family law as well as therights of women, men and children. This article, focusing on the Bill on Family Protection, tries to study familyʹs evolution from the sociological and legal points of views. The first section (sociological view) considers the changes as to the role and place of women, men and children in the contemporary Iranian family. In the second section (legal view), advantages and disadvantages of the Bill are reviewed with respect to the sociological evolutions. Finally, based on legal and sociological findings, we examine the conformity of the Bill on Family Protection with current family evolutions and the possibility of solving family issues and problems.
