دادسراها و دادگاه‌هاي ويژه روحانيت علاوه بر اين‌كه صلاحيت رسيدگي به كليه جرايم و اعمال خلاف شان روحانيون را دارا هستند در موارد خاص، صلاحيت رسيدگي به دعاوي مدني مطروحه بر عليه روحانيون را نيز دارند. با توجه به گسترش صلاحيت آن‌ها در رسيدگي به جرايم مختلف، و دعاوي مدني و افراد تحت شمول و هم‌چنين فراز و فرود آن در مجموعه سال‌هاي فعاليت، از زمان تشكيل تاكنون، و مواضع و بازتاب‌هاي مثبت و منفي آن، در بين حقوق‌دانان و روحانيون، شناخت و توجه بيش‌تر به اين نهاد خاص قضايي را، ايجاب مي‌كند. مبناي اوليه رسيدگي، در همه مراجع قضايي، استناد به قوانين موضوعه مي‌باشد اما در شرايطي خاص و به منزله حكم ثانويه در مقررات فعلي، مراجعه به منابع فقهي در بخشي از دعاوي، تجويز گرديده است. اين تقدم استناد به حكم قانون و تاخر طولي رجوع به منابع فقهي، در نظام دادرسي دادسرا و دادگاه‌هاي ويژه روحانيت تغيير يافته، و با يك چرخش، ابتدا، استناد به منابع فقهي نسبت به قانون در تقدم قرار گرفت و در اصلاحات بعدي، از رابطه‌ي طولي به رابطه عرضي به شرحي كه خواهد آمد، اصلاح و منابع فقهي و قوانين موضوعه، در عرض يكديگر، قرار گرفتند. در اين مقاله، با توجه به اين توضيح به تبيين و بررسي اين روش قانون‌گذاري با توجه به نظام كلي حقوقي حاكم بر كشور، پرداخته مي‌شود.
