Diversity of the Theories of Intellectual Property

اهميت روزافزون حقوق مالكيت معنوي، علاوه بر اينكه توجه و علاقه بسياري را به اين شاخه از حقوق در دانشگاهها و مراكز آموزشي برانگيخته و كشورها را به تحرك و تلاش در تدوين و بازنگري قوانين خود در اين خصوص واداشته، موجب گسترش نظريه‌پردازي در اين عرصه شده است. مقاله حاضر، ضمن اشاره به تنوع نظامهاي حقوقي مالكيت معنوي و تنوع موضوعاتي كه تحت عنوان مالكيت معنوي در اين نظامها به نظم درآمده است، به بررسي سه نظريه عمده براي توجيه مالكيت معنوي، يعني نظريهكار، نظريه شخصيت و نظريه فايده‌گرايي پرداخته و در پي نشان دادن تنوع و تكثر در درون هر نظريه‌اي است. نگارنده از اين رهگذر در پي نشان دادن اين است كه مالكيت معنوي، مفهومي‌ بسيط نيست كه بتوان با نظريه‌اي فراگير به تبيين آن پرداخت، بلكه تكثري از نظريه‌ها مي‌تواند توجيه‌كننده نظم حقوقي مالكيت معنوي باشد.

The increasing importance of intellectual property rights has attracted the attention of universities and research institutes to this branch of law, encouraged the countries to enact laws or review their laws concerning this area. More importantly, it has caused some theorization in this area. In addition to referring to the diversity of legal systems regarding intellectual property as well as the diversity of the subjects regulated under the title of intellectual property in these systems, this article studies three main theories about the justification of intellectual property, i.e. the theory of work, the theory of personality and utilitarian theory. It also tries to show the variety of viewpoints falling under each theory. The author seeks to show that intellectual property is not a simple concept, and thus it could be justified by a complex of various theories and not by a single comprehensive theory.
