Criminal Mechanisms for Confronting Breaches of Industrial Property Rights: And a Viewpoint from Comparative Law

اساسي‌ترين ويژگي حق شناسايي شده در قلمرو حقوق، داشتن ضمانت اجرا يا تضمين اجراي موثر آن توسط دولت و يكي از ابعاد مهم اجرا يا تضمين حق، جلوگيري از تجاوز اشخاص ثالث به آن در پرتو به كارگيري سازوكار حقوق كيفري است. از قلمروهايي كه تحت تاثير پيشرفتهاي تكنولوژيكي و علمي و مطرح شدن ارزش جديدي به نام حمايت از حقوق مالكيـت فكري افراد منجر به مداخله حقوق كيفري شده، حوزه مالكيت صنعتي است. در واقع امروزه دولتها با استفاده از سازوكار جرم‌انگاري رفتارهاي ناقض حقوق مالكيت صنعتي افراد و پيش‌بيني ضمانت اجراهاي كيفري براي متجاوزان به اين حقوق، موجبات ايجاد رشته فني و تخصصي از حقوق كيفري را تحت عنوان «حقوق كيفري مالكيت صنعتي» فراهم آورده‌اند. اين مقاله تلاشي در چارچوب اين شاخه جديد است كه به بررسي يكي از ابعاد مهم آن يعني ميزان مداخله حقوق كيفري در حوزه مالكيت صنعتي و تنوع و نوع ضمانت اجراهاي كيفري پيش‌بيني شده در حقوق ايران و حقوق تطبيقي (فرانسه و انگليس) و اسناد بين‌المللي (به ويژه موافقتنامه تريپس) مي‌پردازد.

The main characteristic of a legal right is its legal sanction, i.e. that its enforcement is guaranteed by the state. An important aspect of such a sanction is that the state prevents the breach of rights by third parties, through applying the mechanisms of criminal law. Industrial property is one of the fields that are subject to the interference of criminal law due to scientific and technological developments and the rise of a modern value named the protection of industrial property rights. Nowadays, through criminalizing breaches of the industrial property rights of individuals and providing for criminal sanctions for it, states clear the way for establishing a technical and specialized branch in criminal law named "industrial property criminal law". The present article is an attempt within this branch to study an important dimension of the subject, i.e. the degree of interference criminal law has in the field of industrial property as well as the various sanctions provided for it this regard in Iranian, English and French laws and international documents (especially TRIPs Agreement).
