Role of Civil Rules in Recognition of Penal Responsibility for Legal Entities

مسيوليت كيفري شخص حقوقي يكي از مباحثي است كه پايه‌هاي خود را در بسياري از نظام‌هاي حقوقي استوار كرده است. موافقان و مخالفان اين مسيوليت، براي شناسايي يا نفي آن، به دلايلي استناد مي‌كنند. واقعيت‌هاي جرم‌شناسي و اعتماد مشروع به فعاليت اين شخص، از جمله دلايل موافقت و عدم تجانس برخي از مجازات‌ها يا اعمال مجرمانه با طبيعت شخص حقوقي، از زمره دلايل مخالفت است. برخي از مفاهيم بنيادين حقوق كيفري مانند قصد مجرمانه، سو نيت، سرزنش‌پذيري اخلاقي و مانند آن نيز در بادي امر، با ساختار شخص حقوقي منطبق نيست و بر اصرار مخالفان مي‌افزايد. در كنار تلاش‌هايي كه براي تبيين اين مسيوليت به‌عمل آمده است، ما نيز در اين نوشتار درصدديم با استفاده از تحليل‌هاي مدني، اين حركت را ادامه دهيم و برخي ابهامات آن را برطرف كنيم.

Penal responsibility of the legal entity is one of the issues which have found their foundations in many legal systems. Opponents and proponents of such responsibility have their own reasons to confirm or deny it. Points of criminology and legitimate confidence in the activities done by this entity are among reasons given for confirmation, and disharmony of some punishments or criminal acts with the nature of legal entities are among reasons posed for denial. Some fundamental concepts of penal law such as criminal intention, evil intention, moral blameworthiness and the like do not, at the first glance, correspond with the structure of legal entities, and this intensifies opponentsʹ denial. In addition to attempts made to explain this responsibility, in the present writing the author is seeking to, using civil analyses, continue this movement, and eliminate some ambiguities.
