تاملي بر مسيوليت بين‌المللي دولت‌ها، ناشي از نقض حقوق بشردوستانه بين‌المللي

Reflection on International Responsibility of States for Violation of International Humanitarian Rights

«طرح پيش‌نويس مسيوليت بين‌المللي دولت‌ها براي اعمال متخلفانه بين‌المللي» كه حاصل بيش از نيم قرن تلاش «كميسسون حقوق بين‌الملل» در راستاي توسعه و تدوين حقوق بين‌الملل است، بر همه حوزه‌هاي حقوق بين‌الملل سايه افكنده است. در اين بين، برخي بر اين باورند كه حقوق بشردوستانه در بستر طرح پيش‌نويس مزبور، به‌عنوان يك «رژيم خودبسنده» قلمداد شده است و فارغ از اصول و قواعد كلي مندرج در آن است. در اين مقاله سعي شده است با مطالعه و تجزيه و تحليل دقيق مفاد طرح پيش‌نويس و تطبيق آن با نظام حقوق بشردوستانه بين‌المللي، نشان داده شود كه حقوق بشردوستانه نيز مشمول اصول و قواعد كلي مندرج در طرح پيش‌نويس است و سيستم خودبسنده قلمداد نمي‌شود.

As a product of more than thirty years attempts made by "Commission for International Rights" to develop and articulate international, "Draft of International Responsibility of States for International Offensive Acts" laws has overshadowed all fields of international laws. But, some think that humanitarian rights has been, in the context of the above mentioned draft, regarded as a self-sufficient regime", and has nothing to do with the general principles and rules mentioned in it. In the present article, having accurately studied and analyzed the content of the above mentioned draft, and corresponded the same with the system of international humanitarian rights, the author tries to show that the humanitarian rights are covered by the general principles and rules, and the system cannot be regarded as being self-sufficient.
