قاعده دفع افسد به فاسد و دلالت‌هاي حقوقي ـ جرم‌شناختي آن

The Rule of "Changing the worst for bad" and its Legal-Criminological Consequences

از جمله قواعد فقهي كه در حقوق كيفري و جرم‌شناسي، به‌ويژه جرم‌شناسي پيشگيرانه كاربردهاي قابل توجهي دارد، قاعده دفع افسد به فاسد است. ادله‌اي كه قواعدپژوهان از كتاب، سنّت و سيره معصومين بر حجيت اين قاعده اقامه كرده‌اند، كافي به‌نظر نمي‌رسد. گرچه در دلالت عقل بر اين قاعده بحثي نيست، ولي تشخيص حدود و ثغور آن كار آساني نيست. اين قاعده به‌لحاظ حقوقي با قواعدي همچون ضرورت، اضطرار، امر آمر قانوني و... تا حدودي در برخي مصاديق همپوشي دارد و به‌نظر مي‌رسد قانونگذار كيفري ايران، اين قاعده را به‌طور مستقل به رسميت نشناخته است و مصاديق مورد پذيرش قانونگذار را بايد در ذيل عناوين ياد شده جست‌وجو كرد. در حوزه جرم‌شناسي، به‌ويژه جرم‌شناسي پيشگيرانه و نيز در مباحث اصلاح و درمان مجرمان، اين قاعده مي‌تواند كاربردهاي قابل توجهي داشته باشد، ولي مهم‌ترين مسيله مرجع تشخيص افسد و فاسد و نيز تشخيص حالت تزاحمي است كه مسيولان را به روا دانستن فاسد براي دفع افسد متقاعد مي‌سازد.

One of the juridical rules which have many uses in the Penal Law and criminology and in particular preventive criminology is the rule of "changing the worst for bad". Arguments posed by researchers from the Book and tradition of the Infallibles (a) for this rule do not seem to be sufficient. Though it goes without saying that this rule is rationally justified, it is not easy to find its limits. Legally speaking and in some instances, this rule overlaps with some other rules such as necessity, urgency, command of lawful superior and the like. It seems that Iranian penal legislator has not recognized this rule independently and instances accepted by the legislator should be found under the above-mentioned titles. In the field of criminology and in particular preventive criminology and education and treatment of criminals, this rule may be of many uses; but the most important point is that who should specify the worst and bad as well as the interfering state which convinces authorities to allow the bad to ward off the worst.
