Study of Testimony of People of the Book

در بسياري از ابواب فقهي، احكامي در مورد اهل كتاب بيان شده است. از مهم‌ترين اين احكام، عدم پذيرش گواهي آنان بر مسلمان است. از اين حكم فقط شهادت بر وصيت، با شرايطي استثنا شده است. در اين مقاله ابتدا به ادله مشهور فقها بر عدم قبول شهادت اهل كتاب اشاره مي‌شود، سپس ادله و شرايط پذيرش شهادت اهل كتاب درباره وصيت بررسي مي‌شود و در نهايت، به روشي تحليلي و استنباطي، امكان پذيرش شهادت اهل كتاب در مواردي غير از وصيت اثبات مي‌شود.

In many juridical branches, commandments concerning people of the Book have been introduced. One of the most important commandments is that their testimony against Muslims is not accepted. In this commandment, only testimony concerning inheritance is excepted, and that with some conditions. In the present article, at first, arguments accepted by jurists for rejection of testimony of people of the Book are mentioned, and then conditions to accept testimony of people of the Book concerning inheritance will be studied. Finally, based on an analytical and deductive methodology, it will be proved that testimony of people of the Book may be accepted in cases other than inheritance as well.
