Problems of Legal Philosophy

بي‌گمان اثرگذارترين فيلسوف حقوق در دنياي انگليسي زبان امروز، اچ. اِل. اِي. هارت است. پروفسور هربرت هارت، استاد كرسي فلسفه حقوق دانشگاه آكسفورد، كتاب معروف خود با عنوان «مفهوم حقوق» را در سال 1961 ميلادي منتشر ساخت. اين كتاب، فلسفه حقوق را كه حدود بيست سال در انگلستان و آمريكا مسكوت مانده بود، دوباره در اين كشورها زنده كرد. هارت كتاب خود را با اين حقيقت قابل توجه آغاز مي‌كند كه تعريف قانون بايد از سرگرفته شود. وي ديدگاهي از قانون را ارايه مي‌كند كه مشتمل بر «يكپارچگي قواعد اوليه و ثانويه» است. قواعد اوليه، نقش تعيين تكاليف را به صورت مستقيم به عهده دارند، اما قواعد ثانويه به مرحله اجرا و تعارض قواعد اوليه مربوط مي‌شوند. پروفسور هارت در مقاله حاضر بر اين باور است كه نمي‌توان ميان مسايل مطرح در رشته‌هاي مختلف حقوق مانند حقوق جزا يا حقوق قراردادها و مسايل مربوط به فلسفه حقوق به تفكيك كاملاً قطعي دست پيدا كرد و بهتر است به مسايلي در فلسفه حقوق بپردازيم كه هنوز بدون پاسخ مانده‌اند. لذا وي مسايل فلسفه حقوق را به سه دسته كلي تقسيم مي‌كند: 1. مسايل مربوط به تعريف و تحليل حقوق. 2. مسايل مربوط به تعريف استدلالهاي حقوقي. 3. مسايل مربوط به تعريف نقادي حقوق. او با طرح مباحثي چون تحليل مفاهيم حقوقي، نظريات توصيفي و دستوري و ارزيابي حقوق، به تفكيك حدود و ثغور مسايل فلسفه حقوق مي‌پردازد.

H. L. A. Hart is no doubt the most influential legal philosopher in todayʹs English speaking world. A professor of legal philosophy at Oxford University, he published his famous book The Concept of Law in 1961. It revived the philosophy of law which was left unsaid for 20 years in England and United States. He begins his book with this notable fact that the concept of law must be started anew. He advances the opinion that law consists of "the integrity of the first and the secondary rules". The former deals directly with the determination of duties, while the latter with the enforcement and conflict of the first rules. In this article, professor Hart believes that it is impossible to make a complete distinction between questions of different branches of law such as criminal or contract law on the one hand and questions of legal philosophy on the other, and it is better to deal with those questions of legal philosophy which have remained unanswered. Thus, he divides the problems of legal philosophy into three categories: 1. questions of definition and analysis of law, 2. questions of definition of legal arguments, 3. questions of critical definition of law, and by setting forth such discussions as analyses of legal concepts, descriptive and normative theories and assessment of law, he delimits questions of legal philosophy.
