The Study of Proceeding of Option in Voidable Contracts

يكي از مسايل عقود لازم، جريان خيار در آن عقود است. فقيهان اين مسيله را به تفصيل مورد بحث و بررسي قرار داده اند، ولي متاسفانه مسيله جريان و عدم جريان خيار در عقود جايز، چندان مورد بررسي و تحليل فقيهان و حقوقدانان قرار نگرفته است، به طوري كه در آن خلا علمي ديده مي شود. دليل اين امر آن است كه انديشمندان حقوق، عدم جريان خيار در عقود جايز را يك مسيله مسلّم تلقي كرده‌اند، درحالي‌كه مسيله محل اختلاف ‌نظر است و براي روشن شدن حكم مسيله بايد مورد بررسي قرار گيرد، تا خلا علمي موجود مرتفع گردد. اين مقاله در صدد تحقق بخشيدن به اين هدف است و اقوال و ادله آنها را براي مقصود مذكور با استناد به تحليل عقلاني و استنباط از منابع حقوق اماميه تحصيل و ارايه كرده است و اين مهم ترين يافته تحقيق محسوب مي شود.

One of the voidable contractsʹ issues is proceeding of option in contracts. Jurisconsults have discussed and studied this issue in detail but regretfully the issue of proceeding and non-proceeding option in voidable contracts hasnʹt been studied and analyzed by jurisconsults and jurists so that a scientific vacuum can be noticed in it. The reason behind the issue is that the scholars of Islamic and Iranian law have supposed that the non-proceeding of option in voidable contracts is a certain issue, while it is not so and there is discrepancy in the issue and it should be studied seriously to remove the existing scientific vacuum. This article seeks to study and analyze the above-mentioned issue and acquires and presents its correct opinion and proof with regard to intellectual analysis and inference from Islamic and Iranian lawʹs sources and this is the most important finding of the research.
