Moral Rights of Intellectual Property and Their Bases

بخش مهمي از حقوق مترتب بر امور فكري، به خصوص در حوزه مالكيت ادبي و هنري، حقوق معنوي اخلاقي است. اين حقوق ارزش اقتصادي مستقيم ندارد و مرتبط با شخصيت پديد آورنده است. پيرامون موارد اين حقوق و مباني اعتبار آن اختلاف نظر وجود دارد. در اين نوشتار، ضمن مرور بر موارد حقوق معنوي، از قبيل حق افشاي اثر، حق نام و عنوان، حق تماميت اثر، حق عدول و حق استرداد، كوشش مي‌شود مباني اعتبار حقوق معنوي مالكيت فكري بررسي شود و گستره حقوق اخلاقي هر مبنا تحليل گردد.

An important part of the rights resulting from intellectual matters, particularly in the area of artistic and literary property, is moral and spiritual rights. These rights do not have direct economic value and relate the personality of their creators. Some instances of these rights and the bases of their validity are controversial. Besides reviewing instances of intellectual rights such as the right to disclosure of the work, the right to name and title, the right to integrity of the work, this article tries to study the bases of the validity of the spiritual rights of intellectual property and the scope of the moral rights of each basis.
