Discretionary penalty (Tazir)

تعزير، در كنار حد قصاص و ديه، يكي ازمهم ترين واكنش ها عليه پديده مجرمانه، در سياست كيفري اسلام است. اين مجازات، كه نوع و ميزان آن، در شرع معين نشده و به نظر حاكم واگذار شده بيشترين بخش دامنه جرايم در حقوق كيفري اسلام را شامل مي شود. اين مقاله، در مورد مفهوم تعزير، و تفاوت آن با تاديب و ساير مجازات ها و اين كه چه رفتارهايي مستوجب تعزير هستند، به بحث و بررسي مي پردازد. همچنين، در مورد اين كه آيا تعزير منحصر به ضرب و تازيانه است، يا فراتر از آن بوده و حبس، جزاي نقدي، تبعيد و امثال آن ها را در مي گيرد، پژوهش شده است. در رابطه با قلمرو جرايم، در حقوق كيفري اسلام، و ارتباط آن با گستره جرايم مستوجب تعزير، و نوع واكنش عليه رفتارهاي مستوجب تعزير نيز، بحث و بررسي صورت گرفته است.

Discretionary penalty, along with retribution and blood money, is one of the most important reactions to criminal phenomenon in islam criminal policy. This punishment, which its kind and its degree is not determined in religious law, and is up to judge|s opinion, covers most of the filed of crimes in Islam criminal law. This paper studies and discuses the concept of discretionary penalty and its difference with discipline and other kinds of punishment, and that what kind of behaviors deserve discretionary penalty. It also studies about this matter that whether discretionary penalty is limited to whiplach, and hitting or it includes imprisonment, fines, exile and the like. About the arena ot crimes in islam criminal law and its relationship with range of crimes, which deserves discretionary penalty, and the kind of reaction to the behaviors that deserve discretionvy, the research is done.
