آثار و ويژگي هاي حق از ديدگاه فقه اماميه و قانون مدني

چكيده شناسايي آثار و ويژگي هاي حق به منظور تمايز بين آن و ساير مفاهيم و تاسيسات مشابه از اهميت خاصي برخوردار است. شناخت اين آثار و ارايه ي آن به عنوان كليدهاي شناسايي حق از ساير مفاهيم جنبه ي كاربردي داشته و اين امكان را فراهم مي كند كه به طور مثال در موارد مشتبه بين حق و حكم، حق از حكم تميز داده شود. اين روشي است كه فقيهان اماميه در بحث از حق به كار گرفته و به طور خاص فقهاي متاخر در رساله‌هايي كه در باب حق و حكم نوشته اند بر آن تاكيد نموده اند. مشهور فقهاي اماميه براي حق در مقايسه با حكم سه ويژگي را برشمرده‌اند: 1. اسقاط پذيري حق 2. نقل پذيري حق 3. انتقال پذيري حق. برخي استادان ويژگي چهارمي را با عنوان امكان تعهد به سلب حق نيز اضافه نموده اند. در اين مقاله اين آثار و ويژگي ها از منظر فقه اماميه و قانون مدني مورد بحث قرار گرفته است.

Abstract Identification of the effects and features of right to distinguish between the right and other similar concepts and facilities is important. Understanding these effects as keys to identify the aspects of the other concepts are applied and it is possible that, for example, in dubious cases between the right and law (hokm), the right is clear. This is how the late Shi’ite jurists in the discussion of the right to work in the treatises, and sentences written on the right and law they have to focus on it. Shi’ite jurists famous for the right confront law, compared with three of features: 1. waiver 2. assignment 3. compulsory assignment. Some scholars attribute the obligation to deny the possibility of adding a fourth title. In this paper works these characteristics on the basis of Shi’ite jurisprudence and civil code perspective is discussed.
