طرح مسيوليت مدني آموزگار ناشي از از عمل دانش آموز در حقوق ايران همراه با مطالعه تطبيقي در حقوق فرانسه

امروزه خسارات وارد بر دانش آموزان و خسارات ناشي از عمل دانش آموزان چنان حجم عظيمي را به خود اختصاص داده كه در برخي از كشور ها ،قسمتي از حقوق مسيوليت مدني تحت عنوان « حوادث آموزشي» به طور ويژه به طرق جبران اين خسارات مي پردازد كه عمده اين خسارات نيز ناشي از تقصير آموزگاران مي باشد.در فقه اماميه قرنها پيش به مسيوليت شخصي معلم اشاره شده است. امروزه يكي از مسيوليت هاي خاص، مسيوليت ناشي از عمل غير است كه يكي از اقسام آن ،مسيوليت آموزگار ناشي از عمل دانش آموز مي باشد. بر خلاف حقوق ايران ،در قانون مدني فرانسه به مسيوليت مدني آموزگار ناشي از عمل دانش آموز نيز اشاره شده وتحولات زيادي نيزدر حقوق فرانسه به وقوع پيوسته است. مسيوليت مدني آموزگار بسيار وسيع بوده و در اين جا فقط به مسيوليت وي در خصوص خساراتي كه دانش آموز بر ديگري وارد مي آورد بسنده مي شود كه در اين مقاله به شيوه تطبيقي مورد مطالعه قرار مي گيرد.

Abstract Nowadays the damages arrived on students and resulting from the students is immense that in some of the country ,the section of tort law in title of thelearning events is for this damages that the grand section of this damages resulting from the faulte of teacher.In the civil code of French the civil liability of teacher is in the side of the liability of the parents.IN civi law of iran there is no regulaqtions for teachers liability and only the article 7 of tort law is about of the guardian that it dosent cover the teachers liability.Becausw the teachers liability is more than the regulations of the article 7 .In dispite of the silence of civil law there is this liability in Islamic jurisprudence.there is interesting regulations in French law about the domain of civil liability of teacher and parents and state and there is more evolution that comprativly is be studied in this article.
