The Nature of Parliament Representation (Based on Feqhi-Islamic Concepts)

امروزه پارلمان (مجالس قانونگذاري) قلب دموكراسيهاي معاصر است. گستره وظايف و اختيارات نمايندگان، آنان را به عناصري موثر و نقش آفرين در اداره جوامع سياسي تبديل كرده است. اما به راستي ماهيت و چيستي نمايندگي در پارلمان چگونه است؟ در اين مقاله، علاوه بر بررسي و نقد برخي از مهم‌ترين نظريات در باره چيستي نمايندگي، برآنيم تا با كاوشي در قواعد و اصول حوزه حقوق عمومي و با استفاده از تقسيم‌بندي قراردادها به قراردادهاي معيّن و غيرمعيّن و با توجه به ويژگيهاي خاص نمايندگي و با در نظر گرفتن مولفه‌ها و شاخصه‌هاي ويژه پيمان نمايندگي، به اين پرسش پاسخ دهيم كه ماهيت نمايندگي مجلس چيست و رابطه ميان انتخاب كنندگان و انتخاب شوندگان از كدام نوع پيمانها و قراردادهاست.

Nowadays, the parliaments are considered to be the basic centers for contemporary democracies. The scope of duties and authority of the parliament representatives has paved the way for them to perform a significant and crucial role in the administration of political societies. But what is, indeed, the true nature of the parliament representation? In addition to analysis and critique of some of the most important theories on the nature of parliament representation, the article seeks to specify the nature of parliament representation and to find what sort of contract governs the relation between the electors and the representatives by making an inquiry into the rules and principles of public law and drawing upon the classification of contracts into nominate and innominate ones and taking into consideration the special characters and constituents of representation.
