The Relation of Expertise to Testimony in Islamic Law and Jurisprudence

رابطه «نظر اهل خرد» و «شهادت» در فقه، به طور متمركز مورد بررسي قرار نگرفته است، بلكه از مباحث پراكنده فقهي در مورد نظر اهل خبره چنين به دست مي‌آيد كه برخي نظر اهل خبره را جداي از شهادت ندانسته‌ و شرايط شهادت را در اهل خبره نيز لازم دانسته‌اند. در مقابل، عده‌اي آن دو را جداي از هم و داراي ماهيت متفاوت تشخيص داده‌اند. در عين حال، دسته‌اي از اين گروه، حدسي بودن موضوع و دسته‌اي ديگر، فني بودن موضوع را ضابطه تفكيك اهل خبره از شهادت، معرفي‌ كرده‌اند. در حقوق موضوعه، «كارشناسي» و «گواهي» به عنوان دو دليل از ادله اثبات دعوي، در قوانين مورد توجه قرار گرفته و احكام و آثار هر يك از آن دو، بيان شده است. با وجود اين، مواردي يافت شده كه تشخيص كارشناسي يا گواهي بودن آن، با ترديد همراه است. علاوه بر اين در برخي قوانين، مواردي تحت عنوان «گواهي اهل خبره» مقرر شده كه تعيين ماهيت آن‌ها مشكل است.

The relation between expertise and testimony has not been focused on in fiqh (Islamic jurisprudence). However, various discussions concerning the opinions of experts indicate that some Islamic jurists do not distinguish expert opinions from testimony and require the qualifications of witness for expert, too. In contrast, there are other jurists who regard these two institutions as distinct, hence of various natures. According to some of the latter group, the criteria of distinguishing between expertise and testimony is the speculative character of the matters concerned, while according to others, the criterion is the specialized character of them. In positive law, "expertise" and "testimony" are treated as two evidences, and their conditions and effects are considered. Notwithstanding, there are instances which are doubtful whether they belong to expertise or testimony. Furthermore, in certain statutes, some instances are cited under the title of" the testimony of experts", whose nature can not be determined easily.
