چكيده فارسي :
هرمنوتيك حقوقي رشته‌اي است كه به مطالعه فرايند تفسير متون حقوقي مي‌پردازد. در اين مقاله، سابقه هرمنوتيك حقوقي، به زمان تدوين كلاسيك حقوق يونان و روم باستان ارجاع داده شده و ظهور آن با رواج و پذيرش حقوق روم در قرون وسطي هم‌زمان دانسته شده است. حفظ، تفسير، و انتقال متون مهم حقوق روم منجر به ظهور رشته خاص هرمنوتيك گرديد. در دوره هاي بعد و به ويژه در دوران بحران يا نوسازي سنت حقوقي، مشكلات متن، تفسير و معنا در قوانين، منجر به احياي دغدغه ها و سنت-هاي هرمنوتيك حقوقي گرديد. در بخش نخست اين مقاله، ريشه لغوي واژه هرمنوتيك تشريح و پس از آن تاريخ‌چه كوتاهي از هرمنوتيك حقوقي بيان مي‌گردد. در بخش دوم، رابطه هرمنوتيك و حقوق مورد بررسي قرار مي‌گيرد. فلسفه زبان، رويه قضايي و هرمنوتيك, بخش سوم مقاله را تشكيل مي‌دهد؛ در همين بخش تعريف گادامر از هرمنوتيك حقوقي و مشكلات فرا روي هرمنوتيك مورد بررسي قرار مي‌گيرد. در بخش پاياني مقاله مبحثي به نام هرمنوتيك حقوقي انتقادي عرضه مي‌گردد كه در آن، رويكردهاي مختلف مكاتب نوين حقوقي نسبت به مشكل تفسير متون حقوقي مورد بررسي قرار گرفته است.
چكيده لاتين :
Legal hermeneutics studies interpretation and meaning of written law. This article traces legal hermeneutics back to the classical codifications of Greek and Roman law, and the development of which has been considered as concurrent with the medieval reception of Roman law. Custody, interpretation and transformation of the great texts of Roman law through ages gave rise to an exemplary discipline of hermeneutics. Later, and particularly in the periods of crisis of renewal of legal tradition, the problems of text, interpretation and meaning of laws led to revival of concerns and traditions of legal hermeneutics.
The first section of this article describes the etymology of the term hermeneutics and then provides a brief history of legal hermeneutics. The second section studies the relationship between hermeneutics and jurisprudence. The third section deals with the philosophy of language, precedent and hermeneutics. It also introduces Gadamerʹs definition of legal hermeneutics and examines related problems. In the last section, entitled "Critical legal hermeneutics", different approaches of modem legal schools to the problems of interpretation legal texts are discussed.
