بررسي تطبيقي اصل ضرورت نظامي در حقوق بين‌الملل بشردوستانه و فقه اماميه

چكيده مقدمه: «ضرورت نظامي» از جمله مفاهيم به كار رفته در اسناد حقوق بشردوستانه بين المللي است. مفهومي پركاربرد و در عين حال مبهم و غير شفاف كه عدم وضوح معنايي و تبيين نشدن حدود و ثغور آن، موجب بروز و ظهور چالش ها و آسيب هاي فراوان در عرصه مخاصمات بين المللي و نيز مخاصمات داخلي شده است. اين مسيله كه «كدام ضرورت» و «با چه كم و كيف» و «با تشخيص كدام متولي»، از جمله مهم ترين مسايل چالش برانگيز و مشكل سازي است كه شفاف نبودن آنها باعث ورود خسارت هاي جبران‌ناپذير مادي و معنوي بر بشر گرديده و مي گردد. يافته‌ها نشانگر ضعف و نارسايي اين مفهوم و حاكي از اين امر است كه «ضرورت نظامي» تاكنون دستاويزي براي اعمال سلايق مغرضانه و غير انساني برخي فرماندهان نظامي يا مسيولان سياسي دول متخاصم بوده است. نتيجه بررسي تطبيقي مفهوم «ضرورت نظامي» در فقه اماميه و اسناد بين المللي حقوق بشردوستانه، از وجود تفاوت‌هاي فراوان بين اين دو نظام حقوقي حكايت دارد. روش‌ها: روش تحقيق، روشي توصيفي و تحليلي است و در آن از منابع معتبر فقهي و اسناد بين‌المللي حقوق بشردوستانه بهره برداري شده است. يافته‌ها: يافته‌ها حاكي از آن است كه «ضرورت نظامي» در اسناد بين‌المللي حقوق بشردوستانه چارچوب مشخص و مدوني ندارد و بيشتر متكي به فهم و برداشت شخصي متوليان مخاصمات بين المللي و غير بين المللي است. تحقيقات نشان داده است كه فقه اماميه ضرورت نظامي را در قالب و چارچوب نظام مند تبيين و تشريح كرده است. نتيجه‌گيري: با بررسي كتب معتبر و دست اول فقه اماميه نظام مندي و مبرهن بودن حدود و ثغور مفهوم ضرورت نظامي به اثبات رسيد و معلوم گرديد كه توجه نويسندگان اسناد بين المللي به مباني حقوقي فقه اماميه در اين باب مي تواند در شفاف‌سازي اين مقوله بسيار كارساز باشد. كلمات كليدي: فقه، حقوق بشردوستانه، ضرورت نظامي، اسناد بين المللي.

This is a widely used, vague and non-transparent concept which does not explain the lack of clarity of meaning and its limits; also it has been caused to emerge enormous challenges in the field of international and internal conflicts. The most important challenging and problematic issues are such as "which necessity", "how" and "who recognizes," which their lack of transparent making irreparable damage on material and spiritual of human. The results indicate the weakness and failure of this concept and suggest that the "military necessity" was an excuse for some inhumane and biased acts of military commanders or political leaders of hostile governments. The comparative study of the concept of "military necessity" in the Emamieh jurisprudence and international humanitarian law documents show that there are many differences between these two legal systems. Methods: This descriptive and analytical study has been used both the reliable sources of jurisprudence and documents of international humanitarian law. Findings: According to the findings, "military necessity" doesn’t have a specific framework in international documents of humanitarian law. This concept is more reliant on personal understandings of custodians of international and non-international conflicts. Emamieh jurisprudence is explained and described the military necessity in the form of a systematic framework based on the researches. Conclusion: By studying the reliable first-hand books of Emamieh jurisprudence, the systematic of "military necessity" concept was proved. Also, it was shown that the writersʹ attention of international documents to the legal principles of Emamieh jurisprudence can be quite effective to clarify this issue.
