ارزيابي و امكان سنجي نظام نظارتي فرادولتي امام خميني(ره)

The evaluation and possibility measurement of Imam Khomeini’s meta- governmental supervising system.

نظارت در اسلام به عنوان يك مسووليت ديني و در ذيل فريضه امر به معروف و نهي ازمنكر نيز تعريف مي گردد. اما با گذشت بيش از سي وسه سال از پيروزي انقلاب اسلامي، دو فريضه امر به معروف و نهي از منكر به درستي اجرا نگشته، بلكه منويات اصل هشتم قانون اساسي هم محقق نشده است. همان طور كه نظر امام خميني(ره) نيز در تاسيس اداره مستقل و فرا دولتي امر به معروف و نهي از منكر هم جنبه اجرايي نيافته است. بدين خاطر، غايت و مساله اصلي اين پژوهش، آن است كه با استمداد از انديشه هاي امام خميني(ره) و پيشنهاد ايشان بررسي شود كه، آيا مي توان امر نظارت در نظام اسلامي را نهادينه تر، اصلاح و بازسازي نمود و نهادي فرا دولتي را در اين زمينه طراحي كرد و چالش ها و موانع در اين زمينه را برطرف نمود؟ نگارنده با استنادات لازم، بر اين باور است كه نظر قطعي ايشان تاسيس وزارتخانه و يا نهادي دولتي براي ايفاي اين وظيفه نبوده است و كاملاً و بسيار هوشمندانه بر تاسيس «دايره» و سازماني فرادولتي، سراسري و تحت زعامت و اشراف روحانيت در اين زمينه تاكيد داشته اند.

Supervision is defined in Islam as a relgiouse responsibility within the “Amre Be Maroof va Nahye as Monkcar” main duty. Though after 33years of the Islamic Revolution the two nesponsibities of “Amre Be Marouf “ and “Nahye as Monkar” have not been appropriately applied, neither the instructions of the eights article of the constitution, nor the idea al the deceased than about the establishment al an independent, meta- governmental organization of “ Amre be Maruof” and “Nahye as monkar”. For the same reason the ultimate purpose of the present study is to see if it is possible to make the supervision in Islamic system more rigorously established, improved and reconstructed through the application of the thoughts and suggestions of Imam Khomeini, and if it is possible to design for a meta- governmental organization for this purpose and remove its impediments and challenges? Presenting the required documentation, the researcher belives that the absolute idea al Imam Khomeini was not to establish a ministry or a governmental organization for this purpose. And so wisely he has put the emphasis on the establishment al a “Dayere he” (union) and meta governmental nation-wide organization under the leadership and mastery of the clerics.
