The General Evaluation [examination] of Options Rules

در اين مقاله، قواعد و احكام عمومي خيارات، به عنوان يكي از سنت‌هاي معمول فقهاي اسلامي در تبيين و تحليل ماهوي خيارات، مورد بحث و واكاوي قرار گرفته است؛ از همين‌رو، در راستاي تحصيل قاعده، كلّي مزبور، ديدگاه ژرف شيخ اعظم انصاري (ره) و برخي از فقهاي معاصر شيعي و نيز گروهي از حقوقدانانِ صاحب‌نظر، به نحو دقيق، مورد مداقّه‌ي علمي با رويكرد انتقادي، واقع شده است كه مي‌توان به موارد «ملاك و ماهيت خيار فسخ»، «نوع حق در خيارات»، «اصل لزوم در عقود خياري»، «سقوط خيار فسخ با تصرّف ذي‌الخيار از روي علم و عمد» و «تلف در زمان خيار» اشاره داشت. بعد از تحليل و تبيين مقام بحث در هر يك از موارد فوق‌الذكر و استخراج مباني و اصول اتخاذي هر يك از ديدگاه‌ها، نظريّه‌ي مختار و ديدگاه تنقيحي ارايه و تبيين شده است.

In this article it has been tried to consider the general rules and provisions of options as one of the common traditions of Islamic jurists. Therefore, in order to reach to that general rule, the profound viewpoint of Sheikh Ansari and some of the contemporary Shiʹi jurists and some highly qualified jurists have been analyzed critically, specially matters such as "criterion and nature of the revocation option", "type of right in options", "the principle of necessity in optional contracts", "cancellation of revocation option with the deliberate act of option holder" and "waste in the option period" have been considered and in each case after analyzing the subject and setting the context of the debate and eliciting the rationales and principles of each viewpoint, the selected view of the authors has been offered and explained.
